The objective of the CSI was to gather information necessary to determine compliance with the requirements and limitations of its minor SPDES Permit No. NY 020 0484. EPA conducted a similar CSI October 2, 2018 which resulted in a number of parameter exceedances. The results of this June 23, 2021, CSI do not show any parameters in excess of their Permit; however, reporting limits for certain analytes are above the Permit limitations. The company employs 37 people on a daily basis and began operations in 1996. The facility is a waste oil reprocessing and storage facility and is categorized as Standard Industrial Classification (SIC) 7699 - Repair Services. The first item of information listed on the SPDES Permit is `Industrial Code' - 7699. This does not accurately represent the operations and activities at this processing facility. According to EPAs ECHO database (screenshot below), their NAICS (in ICIS/NPDES) is 423930: Recyclable Material Merchant Wholesalers (which can be further indexed for Oil, Waste, Merchant Wholesalers). The Permit effective date is 08/01/18, was modified in 11/01/2019, and expires 07/31/23. Page 3 of 13 CWNY Facility Inspection Date: June 23, 2021 NY 020 0484 Process Information CWNY is engaged in marine vessel and tank cleaning, water treatment and oil recycling, and receives a variety of oils from light oils to black oils generated from a myriad of sources. CWNY is primarily a marine-based vessel cleaning facility (plant), authorized by MARPOL to accept various material. The cleaning plant can provide vessels with a variety of cleaning services such as Butterworth, vacuum, ventilation, steam and other services, accommodating barges, tugs, work boats and other marine vessels. Oils can be received by barge, truck, drum or nearby rail. The non-hazardous oils include, but are not limited to, used automobile oils (lube, brake, transmission, gear, etc), fuel oils, industrial oils, non-PCB dielectric fluid and vegetable oils. These oils are aggregated (blended) in the on-site storage barges and processed for industrial reuse. Petroleum-contaminated wastewaters and oils entering the CWNY facility are generated from various marine and land sources. Marine sources include cruise ships, cargo ships, barges, tugboats, and other marine vessels. Land sources include industrial, commercial, and residential sites, which arrive at the facility via trucks. The facility's trucking component, known as William J. Lauer, operates a fleet of vacuum tankers, pump and box trucks. Approximately one-third of the material arrives by trucks, on the average of 5-7 loads per day. In addition, CWNY is engaged in drum disposal whereby petroleumcontaminated liquids, solids, sludges and debris are accepted for appropriate processing. Liquids are treated in the facility, while the solids are consolidated and sent off-site for final disposal. All waste streams entering the facility, regardless of their source, contain a petroleum component to be handled within the facility. Wastestreams are pre-approved through a profiling system to assure compliance with the facility's Quality Control Plan from its NYSDEC Part 360 Permit. Contaminated debris and wastewater from spills and remediation sites, at a minimum, undergo waste profiling to include flash point and halogen analysis, but depending on the source, e.g., contaminants of concern, PCBs, additional parameters may be requested. According to the SPDES Permit Special Conditions, wastewater brought to the site must be in conformance with the requirements of the Part 360 Permit for the facility. This Part 360 Permit confines the operation to the acceptance and treatment of oily wastewater from the cleaning of virgin oil barges, bilge and/or ballast water, synthetic fuel, liquid asphalt, and used oil with the following waste codes: N001 - N008, N010, N013, N016 - N018. Processing of oily waters and waste oils occurs in batch processes. Temporary storage of the liquids at the CWNY facility takes place on two US Coast Guardcertificated, double-hulled barges. Barge 1 has a capacity of approximately 3.5M gallons across ten (10) compartments, or "tanks" separated by internal bulkheads. This barge functions as a large manifold, providing a system of pipelines for pushing, pumping and sucking of the wastewater and includes a vacuum component. This barge is known as the CASABLANCA and all wastewaters initially are pumped to this vessel for manipulation. Barge 2 has a capacity of approximately 0.42M gallons across four (4) compartments, or "tanks". A third, smaller barge, Barge 3, is strictly a crane barge. Their office space, warehouse space and boilers for heating the oil for enhanced treatment are housed on the ECHOLS ship which is permanently docked at the site. The wastewater treatment building is on land. Page 4 of 13 CWNY Facility Inspection Date: June 23, 2021 NY 020 0484 Water and Wastewater Wash water for the Butterworth process to clean the vessels is drawn from Newark Bay. After the cleaning process, the petroleum contaminated water is transferred onto one of the two storage barges. Once a sufficient quantity of wastewater has accumulated, it is separated using a series of steps within the barge, utilizing the principle that oil and water separate. Separation techniques include gravity, heat and/or use of demulsifiers. Cleaner wastewater is apportioned to certain sections while more heavily oiled or dirtier is apportioned to another area to minimize efficiencies and working. The oil is aggregated in separate compartments for sale, and the separated waters are accumulated in other compartments for subsequent treatment in the chemically-enhanced, pH-adjusted dissolved air flotation (DAF) system. Wastewater Treatment The on-site wastewater treatment process is designed for a maximum of 250 gpm, typically operating on a batch schedule when a sufficient quantity of petroleum-contaminated water is accumulated on the storage vessels to run the treatment process. After the water is processed through the DAF system, it is run through one clay and two activated carbon units for final polishing. The water then travels through a flow meter prior to discharge. Figure 1 below, taken from current SPDES Permit, represents the water and wastewater flow schematics and treatment processes of the on-site wastewater treatment system. Solids generated from the wastewater treatment operation are sent to a landfill for disposal. Figure 1: Water and Wastewater Processes Flow Schematic Page 5 of 13 CWNY Facility Inspection Date: June 23, 2021 NY 020 0484 Facility Self-Monitoring Information The permittee collects composite samples using an automated composite sampler. Grab samples are collected from a designated sampling tap which draws from the effluent pipe being discharged through DSN 001. Grab-composites are collected similarly to the manner in which the EPA collected their samples. Samples other than chlorine and pH are sent to Long Island Analytical Laboratories, a NELAC certified facility. Preserved containers are provided by their contract laboratory. EPA SAMPLING/INSPECTION ACTIVITIES Sampling Activities EPA discussed the approximate time frame for the facility's discharge prior to starting compliance sampling activities. It was estimated that the discharge would last approximately 8 hours. To determine appropriate preservation requirements and for permit compliance, the effluent was analyzed for total residual chlorine. This test resulted in an absence of chlorine residual. EPA set up an iced, automated composite sampler which began collecting aliquots at 15 minute intervals starting at 0830 hours at the permitted sampling location for DSN 001. The composite sampler was stopped at 1630 hours. Samples collected from the 8-hour composite sample included metals, mercury, and total suspended solids. The plastic jug was previously rinsed with 5% nitric acid followed by three distilled/de-ionized water rinses. Grab samples and grab-composite samples were collected from a sampling tap which pulls effluent off of the discharge line. Grab-composite (G-C) samples were collected for NVOA, i.e., semi-volatile/non-volatile organic analyses, and consisted of 4 grab samples during the 8hour discharge period. EPA performed a three-point calibration on their pH meter while on-site immediately preceding their pH sample collection. The grab sample for pH collected at 0900 hours resulted in 7.55 S.U. Other grab samples were collected for oil and grease, volatile organics (VOA) and PCBs. All sample containers, preservation techniques and holding times were in accordance with US EPA requirements specified in 40 CFR Part 136. Flow data was obtained directly from the facility's instrumentation. The discharge started at 0805 hours and ended at 1700 hours, resulting in a net discharge for the day of 46,688 gallons. The facility representative declined the EPA offer for split samples. Page 6 of 13 CWNY Facility Inspection Date: June 23, 2021 NY 020 0484 Inspection Activities Compliance Assistance was provided by EPA inspectors providing copies of the Federal Register of the 2021 MUR which lists EPA-approved methods for NPDES reporting as well as the required containers, preservatives and holding times. EPA reviewed the data submitted for the previous four (4) months of DMRs. No issues were noted based upon those reviews. EPA engaged in discussions with facility representatives on options of eliminating their SPDES discharge and instead, tying into the local POTW. Related discussions occurred on the various requirements of waste haulers and septage haulers, relaying the concern of the high scrutiny of this treatment process (hauler profiling) versus a seemingly less frequent sampling and profiling requirement on septage haulers. Metals: All sampling results for metals resulted in undetected except the three listed in Table 1 (above): arsenic, copper, and tin. NVOA: All sampling results for NVOA resulted in undetected. To be noted, for semi-volatile/nonvolatile organic analyses (NVOA) via GCMS: The reporting level of 5.00 ug/L was raised to 10 ug/L for the analyte: Di-N-Octyl Phthalate The reporting level of 5.00 ug/L was raised to 30 ug/L for the analyte: 4,6-Dinitro-2- Methylphenol The reporting level of 5.00 ug/L was raised to 50 ug/L for the analyte: 2,4-Dinitrophenol VOA: All sampling results for volatile organics (VOA) resulted in undetected; however, the reporting limit was raised to 50 ug/L (from the typical 5 ug/L) for all analytes. Thus, a compliance determination cannot be confirmed. PCBs: All sampling results for PCBs resulted in undetected; however, the EPA laboratory reporting limit for most Aroclors is 33 ng/L, and 66 ng/L for Aroclor 1221. The permit limit is listed as 0.7 ng/L and a compliance limit of 200 ng/L. According to the PCB Minimization Program (PCBMP) requirement #1 of their permit, the goal of the PCBMP is to reduce PCB effluent levels in pursuit of the WQBEL of 0.01 ng/L for Total PCBs. The basis for the 200 ng/L per aroclor limit is the limitations of EPA Method 608.3 minimum level for Aroclors. An authentic compliance determination cannot be made for those analytes with reporting limits above the permitted limits. Refer to the attached Laboratory Analytical Report and the previous section for additional details on the analytical results. The EPA Region 2 Laboratory utilized EPA Method 245.1 for the mercury sample, rather than using the permit-required EPA method 1631E (under Footnote 5). In addition, since the reporting limit is equal to the permitted limit, a compliance determination cannot be confirmed. Inspection Findings In addition to the sampling, an inspection of the facility operations was conducted. Nothing was observed or noted during the inspection that contravened the requirements of the permit or the applicable regulations. Facility representatives noted that due to some data being mis-transcribed by the NYSDEC into the ECHO database, their compliance status was erroneously identified as non-compliant, i.e., in violation. As noted in the introduction, the facility is a waste oil reprocessing and storage facility and is categorized as Standard Industrial Classification (SIC) 7699 - Repair Services on the SPDES Permit. During the next modification of the Permit, an alternate, more descriptive SIC should be utilized.
