NARRATIVE The Region 8 (R8) office of the Environmental Protection Agency (EPA) requested multiple facilities be inspected on tribal lands. Eastern Research Group (ERG) under EPA's Contract No. 68HERC21D0007, Task Order 68HERC22F0492, provided assistance to EPA in preparing for, conducting the inspection, and preparing this inspection report. ERG inspected the TBR Service facility located in Hesperus, Colorado on June 18, 2024. The facility was last inspected on December 3, 2021. , contract inspector for EPA, contacted Ms. , representative of TBR Service, to notify the facility about the inspection on May 29, 2024, prior to the inspection. Ms. stated the three underground storage tanks (USTs) had been removed in November 2023. The inspection verified compliance with the federal UST requirements of Resource Conservation and Recovery Act (RCRA) Subtitle I under 40 CFR Part 280. Upon arrival at the facility, Mr. introduced himself as a contract inspector for EPA, presented his credentials, and provided an in-brief to Ms. , to explain the purpose of the inspection. Following the inspection, Mr. concluded with an exit brief to inform the facility of preliminary observations identified during the inspection and had Ms. sign the Notice of Inspection (NOI). Mr. took photographs during the inspection. UST System Description TBR Service (facility) is located at 6740 CO-140, Hesperus, CO 81326. According to the previous EPA inspection report and observations, the facility had three STI-P3 USTs installed in 2000. TBR Service had the three USTs removed in November 2023. No documentation concerning the removal was provided. Ms. stated that all of the documentation was submitted to the State of Colorado. No USTs or dispensers were observed on site. Mr. completed an EPA Region 8 UST Compliance Inspection Checklist while on site which is included in Attachment A. Photograph #1 in Attachment B shows where the dispensers were located. Photograph #2 in Attachment B shows where the USTs were located. UST System Records The listing of documents reviewed for the TBR Service inspection included the following: 1. Insurance Coverage Certification The facility no longer maintains their records for the UST system since the removal of the USTs. Ms. provided a copy of the insurance policy for the USTs she has been trying to cancel for several months (see Photographs #1 and #2 in Attachment B). Ms. stated that analytical results of the soil samples collected during the tank removal did not indicate the presence of a release and no further action at the site was required.
