In response to your inquiry regarding the above captioned claim,
please be advised that the case was settled for a total amount of
$36,000. This figure represents a compromise settlement to the
widow of
., deceased.
The full liability value of this case was $250,000 which repre sented 20 years of benefits payable under the Illhois Worker's Com pensation Act for a death claim.
I enclose for your review a copy of an interview taken by Mrs*
attorney, John Burtker. You will note that Mrs.
was prepared to
testify at the Illinois Industrial Commission that the claimant on the
day prior to his death complained to her of working extremely hard at
Sherwin Williams.
As you know, Mr,
had had prior heart attacks dating back to 1965.
The <Etna Casualty & Surety felt that there was exposure for death bene
fits to the widow should this case be tried at the Illinois Industrial
Commission, The premise on cases being heard at the Industrial Commis
sion is to protect the employee at all costs.
I also enclose for your review the lump sum settlement contracts and the separate settlement and agreement release executed by the widow md her attorney. You will note that the widow received $1000 in cash in a lump sum and is to receive $200 per month to a period of 240
