Niemczyk and Roy: The United States Environmental Protection Agency (USEPA) is charged with the protection of health and the environment under Section 3008 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act (RCRA) of 1976 and the Hazardous and Solid Waste Amendments (HSWA) of 1984,42 U.S.C. 6901 and 6928. On or about August 24, 2023, I, a duly authorized representative of EPA, conducted an inspection of Chemspec-API (formerly API Inc.) located at 10 Industrial Road, Fairfield, New Jersey 07004. This inspection was performed pursuant to Section 3007 of RCRA, 42 U.S.C. 6927, to evaluate your compliance with RCRA. Attached you will find a copy of the inspection report I prepared. Although one RCRA violation was cited you agreed to correct the issue at the closing conference of the inspection. That violation is cited in Section III of the report (See Section III - AREAS OF CONCERN.) Specifically that violation is: 1. The facility failed to submit a revised Notification of RCRA Subtitle C Activities (USEPA Form 8700-12) pursuant to 40 C.F.R. 262.12 (2015) to reflect the facility's ownership change and name change (from API Inc. to Chemspec-API). Thus, this letter closes out the inspection. Please note that failure to correct the above referenced violation may result in future enforcement against your facility by the USEPA.
