Dear Mr. Merrell:
This letter will confirm our consent to extending the discovery deadline for the purposes of taking the deposition of Mary Gaffey. You indicated that you would agree to postponing her deposition until the depositions of other, more relevant witnesses have been taken. We agree to postpone the deposition of Mrs. Gaffey currently scheduled for Saturday, November 27, 1993, until a later date. Dr. and Mrs. Gaffey will not object to an amended notice for Mrs. Gaffey's deposition on the basis of the Court's pre-trial Order requiring that the deposition be concluded by December 3, 1993. However, it is understood and agreed that Mrs, Gaffey may still file a motion to quash the subpoena and for protective order on grounds other than the Court's pre-trial Order within reasonable time after receipt of the amended notice, thus extending the deadline for filing a motion to quash or Rule 45 objections to the subpoena duces tecum.
