Administrative Matters. * CMA 061733 MINUTES OF MEETING MCA EXECUTIVE COMMITTEE The Links Club, New York City Tuesday, May 14, 1974 Following breakfast at 8:00 a.m. , the meeting was called to order by Chairman St. Clair. Financial Report for Eleven Months Ended April 30, 1974 Mr. Best reported the information shown in Exhibit A, attached hereto. 2. Report of the Nominating Committee Dr. Gerstacker, chairman of the Nominating Committee, reported Officer and Director slates are now complete, and reviewed the list of candidates. (Details in Board of Directors minutes for this same date. ) 3. Proposed Data Bank on Chemical Risk Characteristics Attached to the agenda was a brief description of a proposal that MCA develop a data bank of toxicological and related data on individual chemicals, based on information contributed principally by member companies, with a view to facilitating the availability of such information to governmental agencies. The description included reference to prior consideration of a generally similar project for accumulation of chemical data, covered in an MCA - contracted study by Booz-Allen & Hamilton Inc. in 1965, which was decided not to be feasible at that time. Mr. Driver indicated a continuing staff study is in progress, including a preliminary indication of the extent to which such data might be made available by member companies, involving consultation with personnel of MCA committees functioning in the respective areas of related concern, and a review of possible legal implications. Further discussion brought out the desirability of attempting to prognos ticate regarding future potential problem areas, to enable dealing with them in a preventive way, and the possibility that chemical data assembly might concen trate on such areas. One objective would be to identify data deficiencies so that filling them might be considered. CMA061734 2- - 4. Eitigation on EPA Water Effluent Regulations Mr. Symington reviewed the information conveyed to Executive Contacts in Mr. Driver's letters of April 12 and 17 and May 3, explaining MCA's limited participation in the litigation and furnishing information on the chemicals covered in suits entered by various companies. Mr. Symington stated there are now 15 com panies litigating, with others considering it; MCA is the only trade association so involved. He gave assurance of continuing his close liaison, and providing additional information about the litigation for MCA distribution on a current basis. 5. Trade Secrets Protection Mr. Symington also reported on yesterday's Supreme Court verdict supporting trade secrets' protection under state laws in Kewanee Oil v. Bicron, in which MCA had filed an amicus curiae brief arguing for such protection, 6. Proposal to Monitor Japanese Patents Distributed in advance with the tentative agenda was a proposal that MCA contract with a patent infor mation service to monitor the issuance of Japanese patents for a six-month period at a cost of $2,800, funding to be provided by voluntary subscription from 20 companies represented on the Technical Information Retrieval Com mittee. It was agreed to recommend Board approval. 7. Proposal for Supplementary Vinyl Chloride Research Distributed in advance with the tentative agenda was a proposal to extend the current program of toxicological research, being administered by MCA on behalf of companies having interest in vinyl chloride/polyvinyl chloride, to include metabolism and teratogenesis studies, animal inhalation studies at lower vinyl chloride concen trations, and an acute inhalation animal experiment. As much as $500, 000 may be required for this work, funding to be provided by voluntary subscription from participating companies. It was agreed to recommend Board approval. 8. Administrative Matters (a) Further Visitation with EPA Administrator Train Interest was expressed in continuing the dialogue between members of the Executive Committee and the EPA Administrator which was begun on February 21, 1974. in which water pollution regulation was the main topic of discussion. It was the consensus that toxic substances control would be logical for such an interchange, but not until the pending legislation on that subject is enacted. It was agreed to plan for the visitation promptly thereafter. CMA061735 -3- (b) Professional Employees Mr. Driver reported having been contacted by the American Chemical Society with a view to improved liaison on professional employee relations, and that Mr. Best had been similarly con tacted by the American Institute of Chemical Engineers. It was suggested the American Institute of Chemists might be considered in this connection, also. (c) Office of the Chemical Industry Trade Advisor Mr. Driver commented on Dr. Dawson's assessment that enactment of trade legislation this year is becoming increasingly remote and, on that account, some modifi cation of the OCITA activity may be in order. Dr. Dawson plans to present an appraisal and recommendations at the June meeting. (d) March 1975 Board Meeting There being no knowledge of interest in any particular site for a regional meeting next March, it was de cided to schedule it in Washington, D. C.
