The latest development with EPA's "National Emission Standards for Hazardous Air Pollutants" is that the draft has been sent back to North Carolina (again) for rewrite. Although asbestos is not being reconsidered, (presumably the rewrite concerns only beryllium) the result will be a delay which will allow for the continued sale of MK-3. The regulations will be delayed approximately three months, which pushes the expected promulgation date back to late December, 1972.
Regarding the actual date of compliance, it appears that there will be no requirement of compliance within 90 days after promulgation of the regulations. This would mean that the changeover from MK-3 would not take place until sometime in March, 1973, at the earliest.
As indicated in my August 11 correspondence, it is probable that our customers can obtain a waiver beyond this 90 day period. As we learn more about the waiver procedures, we will let you know.
