Interviewed Mr. Herman Date of Visit 3/26/35 1 - Purpose of Oall or Report 2 - Accomplishments 3 - Action Needed (1) To "be examined hy Tuller & Moosman's attorney in connection with our suit against Tuller & Moosman. (2) Mr. Novaek, attorney for Tuller & Moosman, did not wish to con tinue my examination and preferred to continue with Freer and Wilkens, who were not present (at Mr. Herman's instructions.) Considerable discussion took place between the attorneys with a view to arriving at a satisfactory settlement. Mr. Novaek continued to express the statement that Tuller & Moos man have nothing to lose, but finally was convinced by Mr. Herman that all of us are losing too much time on it, and it was agreed that Mr. Herman would contact John Kennedy & Co.'s attorney to determine how much money is due Tuller & Moosman and how much of it is indisputable and collectable by Tuller & Moosman. Then, Mr, Herman is to submit to Novaek a plan if possible of satisfying our compromise figure and still leave some money for Tuller & Moosman. After this meeting, I expressed my personal view to Mr. Herman that it may be wise to discuss with Mr. Spargo the possibility of set tling on a definite compromise figure out of money now collectable from Kennedy and the balance of our total claim may be agreed upon as. due us, and to be collected from the claim of "extras" Tuller & Moosman have against Kennedy. There is a reasonable ohanoe of re alizing something on the latter. (3) No further action needed at present since any action will depend on later developments arising out of Mr. Herman's conference with Kennedy's attorneys, DUP050061427 N41364.01
