On February 1* 1974, we sent the O.S.H.A. area director a required 30 day progress report on asbestos fiber control. In this report I indicated that we would have our permanent engineering controls completed and in full use by 2/11/74.
I have now been advised by O.S.H.A. that we can expect an O.S.H.A. rclnspcctlon on 2/11/74 or shortly thereafter. In this regard we plan to curtail Joint System production on 2/9/73 and clean up the entire work area.
My main concern is regarding their requirement that we, "Establish a personal
monitoring program to determine, at 6 month intervals, the concentration of asbestos
dust." Our lost series of tests cost us nearly $1,000 and were unacceptable
by O.S.H.A.
I have requested O.S.H.A. to supply me with the names of consultants
to run the required tests that would be acceptable. A list of consultants has been
supplied, see attached. But to quote the area dlrector,"the results would not be
acceptable to determine O.S.H.A. compliance." So it would appear that we should
take steps to have the tests conducted in as inexpensive a manner as possible. We
need to know for our own purposes how our controls are working, but we do not need
to have a high priced consultant and laboratory to lend credit to the tests if
tests other than by O.S.H.A. will be unacceptable.
I believe we will pass this inspection with no real problem. However, I was in hope that we could have a 6 month self inspection program and not look forward to regular visits from O.S.H.A. Inspectors. Now it would appear that we can expect regular testing by O.S.H.A. until we remove asbestos from all of our products.
The attached list of consultants may be of some value to our other operations, but they should realize that tests other than by O.S.H.A. are not acceptable to the Department of Labor.
We will keep you advised regarding the outcome of the 2/11/74 inspection.

Dear Mr. Rauch:
Your letter dated February .1, 1974 has been received and reviewed at this office. Please be advised that we are aware that your administrative controls and permanent en gineering controls will be in full use by February 11, 1974 and that these controls are within the dry mixing and packout areas to prevent employee exposure to asbestos dust.
Your request for consultants to run tests acceptable to OSHA was also reviewed and to this end we are submitting a list of individuals and companies capable of performing asbestos dust sampling. However, the results would not be acceptable to determine OSHA compliance.
To determine if the permanent engineering controls are effective, one of our OSHA Industrial Hygienists will resample the workplace. It is anticipated that this sampling will be conducted on Febru ary 11, 1974 or within seven working days after this date. Based on the OSHA sampling results, you will be informed if the perman ent engineering controls are adequate.
Meanwhile, temporary administrative controls (PPE) are to be conducted pending the outcome of our sampling.
