District Court, Lake Charles, No. 14090 Gentlemen: On March 5 I notified you that this trial was set aside, and to date, it has not been rescheduled. There is some indication that the case may not be heard until some time in the Fall Term, or after September, 1970. The sampling tests being conducted by the Louisiana Air Control Commission are still being undertaken, and I am not certain how much longer they will continue. You should con tinue to observe your daily operations and be in a position to advise whether any activity or occurrence in your operations may be correlated or connected in any manner with any high con centrations of any fumes dr particulates that these tests may indicate in the area of Mrs. Clark's home in Westlake. I will locate all reports that the Air Control Commission may make and forward them to you. Any mechanical or procedural break down or change in plant operations which on any given occasion might cause more stack emissions than usual or customary should be noted by you, and we will then be in a position to see if 0000031*76 CUH Re;: Clark v.. To date, the tests have shown* fairly low levels of all gases tested for, hut on*, one or two occasions have indicated a high level of particulates. On those occasions I do not believe we would he involved, taking- into, account the wind direction. You should, of course, continue to diary all com plaints of any nature.
