CALL TO ORDER at 8:00 A.M. by President Casey II. ROLL CALL The membership present was identical to the first day with the following additional attendees: C.W. Kaufman D.E. Houston III. SPEAKERS David Clark Company, Inc. Safety Clothing & Equipment Co. President Casey turned the chair over to Vice President Robert M. Edmiston, who introduced William E. Wickens, Esq., Howrey, Simon, Baker and Murchison, Washington, D.C. Mr. Wickens reviewed in detail the Brief he submitted to NIOSH on May 31, 1974 on behalf of ISEA concerning 42 CFR Part 83. He indicated his Brief was a twopart thrust with the first section indicating the proposed rules exceed the authority, of the Secretary of HEW, and the second part dealing with needed changes should the Industry be unsuccessful in challenging the statutory authority. Mr. Wickens emphasized that in his view NIOSH under Section 22 does have the authority to develop and establish recommended Occupational Health and Safety Standards, however, the proposed rule making goes beyond the recommending of standards in that it deals with manufacturing procedures i.e., testing and certification. Mr. Wickens recommended the Association not undertake litigation at this time because there is no guarantee we would win, and secondly if the case was won the 94th Congress could correct this Legislation in short order. Mr. Wickens recommended negotiation at this time and participation in the NIOSH Hearing which has been scheduled for July 18, 1974 at Rockville, MD. He recommended the Association name a spokesman to .appear at the-Hearing together "with a panel of experts covering Head, Eye and Foot Protection. At this point Mr. Liautaud introduced a motion, which was seconded by Mr. Sellstrom, and tabled for a lack of a quorum that the Board of Trustees select a spokesman and a committee to appear at the July 18 Hearing. It was subsequently determined the Board of Trustees had the authority under the ISEA Bylaws to appoint this committee. It was recommended the statement to be presented at the July 18 Hearing be developed as quickly as possible by Mr. Wickens and submitted to the members in advance of the Hearing. Mr. Hirschmann' suggested comments already submitted by individual companies to NIOSH be sent to Mr. Wickens through the Executive Director's office. It was also decided the Executive Director would send comments to Mr. Wickens from the various Product Groups. It was also recommended that Product Groups other than Head, Eye and Safety Footwear should also develop comments on the proposed regulations and submit these to the Executive Director as quickly as possible. CALL TO ORDER at 2:00 P.M. by President Casey II. ROLL CALL The mSnbership present was identical to the morning session on this same date. III. SEDA LIAISON REPORT President Casey announced- that in view of the fact that this session was being held on Wednesday afternoon, rather than on Thursday morning as originally scheduled, Mr. Milton Horn, President of SEDA would address the Annual Banquet tonight. IV. REPORTS OF PRODUCT GROUP ACTIVITIES Vice President Edmiston read the attached reports from the various Product Group Chairmen. Mr. Kaufman announced the recent release of a new Canadian Standard on Hearing Protection. V. PRODUCT GROUP CHAIRMEN ELECTIONS The Executive Director reported on the results of the recent balloting for the Chairman and Vice Chairman of the various groups. The results, are appended to these minutes. VI. PRESIDENT'S REPORT President Casey presented an oral report summarizing the activities of ISEA during the past year. He emphasized the importance of Product Group activities, pointing out these programs are of major importance to all members. He also encouraged the various Product Groups to name Membership Chairmen. Mr. Casey also comnented on the Association's relations with Government Agencies, and he also elaborated on the establishment of the new ISEA office in Arlington, Virginia. VII. COUNSEL'S REPORT James McGarry, the Association's Counsel presented the enclosed report and commented particularly on statistics, membership matters, contacts with Government Agencies and discussed in some detail the matter of Foreign Membership. -2- J* VIII. FINANCIAL REPORT AND BUDGET The Executive Director presented the attached audited financial report for the year ended May 31, 1974. He also submitted the attached suggested expense budget for the year ending May 31, 1975. On motion by Mr. Clay, seconded by Mr. Crider and carried, both the financial report and Budget were, approved. IX. REPORT OF THE NOMINATING COMMITTEE AND ELECTION Mr. Weiss, Chairman of the Nominating Committee reported his committee has submitted the following slate to the membership: John A. Casey, President Robert M. Edmiston, Vice President R. Leo Prindle, Trustee (three years) Kenneth F. Keefe, Trustee (three years) Eugene W. Merry, Trustee (one year) At this point, Mr. Ben Simmons was recognized who read the attached letter, and announced the slate of officers-he had suggested to the membership was being withdrawn. Upon motion duly made and seconded, with respect of the total proxies received, the slate as presented by the Nominating Committee was unanimously elected. X. OTHER BUSINESS Mr. George Dickson thanked the members of the Association for the many letters of condolences he and his family received on the passing of his father several months ago. XI. ADJOURNMENT There being no further business to come before the meeting, a motion to adjourn was adopted. DKS 303
