Dear Tony:
This is to report my attendance at the worker's compensation hearing held in Hamilton on March 25, 1985. The claimant attended the hearing. The hearing officer was Phillip Reid. Crystal Stultz, who was scheduled to appear, could not attend.
As you know, the hearing concerned the Company's motion requesting a determination on the issue of claimant's current extent of disability and its causal connection with his industrial condition. I informed Mr. Reid that at the Company's request for an update on claimant's condition, claimant's attending physician had responded that claimant had angina pectoris making him totally and permanently disabled. I pointed out that the claim had only been recognized for a lung condition and that the inception of the angina condition predated his industrial claim.
I cross-examined claimant on his history as is related to chest pains. He admitted having a myocardial infarction in 1974 and also admitted that he had, prior to 1974, a history of smoking about one pack of cigarettes a day for about 15 years. Claimant denied any knowledge of the results of the pulmonary function tests conducted in June of 1984.
