AIA-17 ASBESTOS INFORMATION ASSOCIATION/NORIH AMERICA A meeting of the Board of Directors was held pursuant to notice on July 7, 1971 at 10:00 A. M. at 22 East 40th Street, New York, N. Y. The following aeabers were present by their indicated representatives: Fllntkote Company Johns-Manville Corporation National Gypsun Corporation Panacon Corp. Raybestoe-Manhattan Corporation J. A. Rishel W. P. Raines-^ A. H Fay E. W. Swain S. P. Stefl Also present, at the invitation, of the Board, were the following members of the Administrative Sub-Committee: E. M. Fenner, M. M Swetonic, carl Thompson and James Callaghan. Also present was G. Earl Parker, Assistant Secretary of the Association. Present by special invitation of the Board was George Barge, Executive Vice President, Atlas Asbestos Co., Vincent Greens of. Armstrong Cork, and A. R. Rump of U. S. Gypsum. Mr. Fay acted as Chairman of the meeting and Mr. Parker acted as Secretary of the meeting and kept the minutes thereof. Upon motion duly made and seconded, the minutes of the meeting of the Board held on April 16, 1971 were approved. Hie Chairman informed the Board that Atlas Asbestos Co. had applied for membership in the Association. Whereupon, on motion duly made and seconded, the application of Atlas Asbestos Co. for membership in the Association was unanimously approved. The Chairman advised the Board that the By-Laws provided that membership on the Board of Directors shall be not less than five or mors than fifteen representatives as established by resolu tion of the Board. It was recommended that Atlas Asbestos Co. be elected as a Director. Whereupon, on motion duly made and seconded, the following resolutions were unanimously adopted. RESOLVED that the number of Directors of the Association shall be nine. 01-0216766 AIA-17 RESOLVES that Atlas Asbestos Co. be, and It hereby Is. elected a Director of the Association to serve until the next Annual Meeting of tbe members of the Association or until its successor shall have been duly elected and shall have qualified. Thereupon, Atlas Asbestos Co., by Its designated represen tative. George Barge, joined the meeting as a Director and participated in its deliberations. The Chairman informed the Board that U. 8. Gypsum and Armstrong Cork had been tendered an invitation to join the Association. Mr. Raines discussed the proposed Environmental Protec tion Agency regulations and tbe hearings to be held thereon. The Board authorized the presentation of testimony on behalf of the Association at the scheduled hearings in Washington. The Chairman will designate a spokesman for the Association after further study of the proposed regulations. Mr. Fenner is to communicate to the Board on the proposed regulations as soon as he receives them (probably early August). Mr. Raines and Mr. Swetonic discussed the status of other proposed regulations dealing with the banning of asbestos spray and the control of asbestos use. Particular emphasis was given to the proposed regulations of the Illinois Pollution Control Board. The Chairman designated Mr. E. P. Stefl as Chairman of a committee charged with investigation of the proposed regula tions on asbestos emissions and products. The Committee Chairman was to select additional members of the committee. The Committee will recommend actions to be taken in respect of the proposed Illinois regulations. The Friction Materials Standards Institute will be consulted with a view to wards obtaining their cooperation in this effort. Mr. Raines informed the Board that the Food and Drug Ad ministration is in the process of deciding whether or not to re call all asbestos-containing wool coats now on the market or already sold. The Board was requested to advise the Committee on what position should be taken in respect of the use .of asbestos in general wearing apparel. It was the consensus of the Board that the use of asbestos as an additive in textiles 01-0216767 AIA-17 for general wearing apparel was a *ia-application of the uni que characteristie* of asbestos. Evidence adduced to date would not Indicate a hazard to the wearer under normal condi tions. Nevertheless, it was the consensus of the Board that the government action to restrict further manufacture of these coats, as a precautionary measure, was In the public Interest. The results of tests conducted by a member of the Association are to be made available to the Board. The Board discussed a pending Senate bill to amend the Federal Hazardous Substances Act. The proposed amendment may be cited as the Toxic Substances Control Act of 1971. It was pointed out that the word "toxic" would not, under generally accepted definitions, include asbestos which is an inert sub stance. It was further pointed out that the term "chemical substance" would also, under generally accepted definitions, exclude asbestos. Nevertheless, it was the understanding of some members of the Committee that asbestos was one of the substances being considered by the Committee staff in drafting the proposed Act. It was the consensus of the Association that the viewpoint of the Association should be made known to the Senate Commerce Committee, and the Chairman appointed E. P. Stefl as Chairman of a committee to inquire into the proposed Act and to prepare and arrange for presentation of the viewpoint of the Association. The Board discussed the desirability of having counsel . for the Association separate from counsel for any of the indi vidual members thereof. Thereupon, after discussion and on motion duly made and seconded, Bradley Tails of Burns, Van Kirk, Jube k Kafer, New York City, was selected as counsel for the Association. The difficulty in finding a convenient time for meetings of the Board was observed. The Chairman authorized the Secretary to call special meetings of the Board of Directors when necessary to tend to pressing natters. Mr. Fenner Informed the Board that he had been requested to chair a committee of the National Standards Institute to develop asbestos emission standards for Industry. Mr. Fenner requested the names of volunteers from member companies to serve on that committee. National Gypsum, Raybestos-Manhattan and Flintkote representatives indicated that appropriate per sonnel from their respective companies would be available for such service. 01-0216768 AIA-17 Advertising being placed over the naae of the Associa tion was discussed. A copy of the most recent advertiseaent was distributed and various aeabers requested reprints of such advertiseaent for their use. For planning purposes, an estlaated budget for 1972 was distributed to the Directors. The budget, described as the alniaua essential, was discussed itea by itea. The Chairaan indicated that a formal budget would be presented to a sub sequent meeting of the Board for adoption. The Committee on dues and membership presented its re port. The Committee recoaaended that members who serve on. . the Board of Directors (active aeabers) be assessed dues in proportion to their conversion of asbestos fiber. Active . aeabers who mine asbestos fiber and who do not support the Quebec Asbestos Mining Association would pay dues on the basis of their production of asbestos fiber. Other aeabers would be assessed dues on the basis of a flat annual fee. The figure of $9,000 was suggested as an appropriate annual dues for such supporting aeabers. Each aeaber will be requested to submit to Association counsel its annual conversion of asbestos fiber in 1970. Such figures are to be maintained in confidence by counsel who will coaplle the figures and make known to the As sociation the total tonnage of fiber converted by aeaber coa-^ panles during 1970. On the basis of such figures, the Board will establish dues in 1971 of a number of cents per ton. Counsel will then assess dues on the basis of tonnage figures presented by the aeabers. The Chairaan of the Administrative Committee was authorized to cooperate with counsel in soliciting the aeabershlp usage of asbestos fiber. It was proposed that a seminar on asbestos and health be arranged during the early part of Septeaber. Prospective supporting members of the Association are to be invited to attend. Copies of the invitation and a prospectus are to be provided to the Board for review and comment prior to distribu tion thereof. A list of approximately two dozen prospective supporting aeabers which had been compiled by the Membership Committee was read to the Board. Other names were suggested by the Board. Members were assigned the responsibility of con tacting the prospective members and inviting them to attend the 1-0216769 AIA-17 proposed seminar. Upon his request, the Secretary was authorized to change the telephone and office address of the Association. The status of regulations on the spraying of asbestos for the purpose of fire prevention and retardation was discussed. It was the consensus of the Board that the efforts of the As sociation could sore profitably be directed toward other areas of concern.
