W. WASHINGTON, D.C, 2 00 0 6 2O2|330-7722 S ep te m b er 27, 196S To: SHIPYARD MEMBERS AND SAFETY COM M ITTEE Subject: W alsh-Healey Act, Revised Health and Safety Standards Enclosed is a copy of revised Health and Safety Standards for F ed eral Supply Contracts under the W alsh-H ealey Public Contracts Act and the press release issued by Labor S ecretary W irtz at the tim e of publication of the p roposals in the FEDERAL REGISTER- The revised standards parallel the reg u la tio n s published in the F E D E R A L R E G IS T E R July 10, 1968 applicable to co n tracts covered by the S erv ice C ontract A ct of 1965. ' , This continuing effort within the Departm ent of Labor to adopt uniform regulations covering all F e d e r a l statu tes which include safety features was predicted at a meeting of the Council's Safety Comm ittee with Bureau of Labor Standards staff last July, - It was disclosed at that tim e that the W alsh-Healey regulations w ere up for review to m ake them corresp o n d m o re closely to the new Service Contract Act regulations. > The proposed revised W alsh-Healey Health and.Safety Standards deal with such m atters as occupational noise exposure; ' radiation exposure; exposure to harm ful gases; vapor fumes; dusts and m ists; m aterials handling; safety guards on m achines; com pressed gases; welding; traffic safety; and record keeping. Our reaction is that these revised rules should receive m ost careful scrutiny by shipyard staff to ensure that this op portunity for review by industry w ill not be lost. F o r instance, in one obscure paragraph on the last page it should be noted that S ectio n .50-207. 74, covering safety p ra c tic e s for welding PLAINTIFF'S E EXHIBIT | SBCA 5077 j and cutting containers which have held com bustibles, requires that the w ork be in strict accordance with the rules and p r o cedures embodied in A m erican Welding Society Pam phlet A -6. 0-65, edition of 1965. Does this m e a n application of th e se rules to welding in ship construction and repair? A ccording to the notice, a hearing has been scheduled on the proposed rev isio n for N ovem ber 6 at 1:00 P. M. in Room 2 1 6 b of th e L a b o r D e p a r t m e n t Building in W a s h in g to n , D. C. To assure proper Council participation and preparation for this hearing, we would greatly appreciate any prom pt com m ent you m ay have on the pending revisio n so that a position p ap er can be drafted by the Safety C om m ittee for subm ission by the Council.
