Thin action Mould also Actuate the pro visions of the Federal Hazardous Sulvstances Act dealing with repurchase of Banned Hazardous Substances. The enact impact of this requirement is not certain at this time, but it cnukl be financially disastrous for manufactur ers and dealers. \Mu1c it may lie possible for all mciiilien of the industry to comply with a .067 lead Ipvrl if given ade quate time to rrfonmilalr and proper ly test their products, the National I'aiut and Coatings Association does not feel ilial tlic tone table presciilied . tile I lit regulation provides the adeipiate time, particularly since alt Imusrhold paints (both exterior and interior) are covered. Furthermore. NPCA feels stiongly that the .06S level should mg he presciilied until appropriate research, including ani mal-feeding studies, has proved that levels In excess of that figure are a significant hazard. The new regulation is published under the provisions of the Federal Hazardous Substances Act. NPCA has objected strongly to FDA and to the Senate Labor and Public Welfare Subcommittee on Heekh (which was conducting hear ings sm Senate Bill 3080) on the .OH lead Imitation. In a press statement immediately after the FDA action, NPCA Executive Vice President Bob. ert A. Roland said "the regulation... does nothing to address the real identified problem of lead poisoning present now in major metropolitan areas." He added that "the paint in dustry had been sacrificed on the altar of politics," and that "the regulation would impact seriously on small re tailers and manufactured." '"\he NPCA Legal Division is study 's' the regulation in detail A special meeting of tiie NIT.A Executive Com mittee has been culled by President Ralph Itaudlmiu In consider action challenging this unreasonable regula tion. A Legal Bulletin providing copies of the regulation and a com plete .ui.tlvi.fv is under preparation by tins NPCA. Senate Bill S.3080 Senator Edward Kennedy has pn> pacd several amendments to the 1971 Lcud-Hased Paint Poisoning Preven tion Act which would reduce the aL lowulile lead content in interinr paints to .1)67 and appropriate an additional SSI milKon for the treatment and detccti<Ni of lead poisoning. Mr. Kennedy's bill - S.3080 would amend Section 501 (3) of the Act li> reducing "1 perrenlum lead by weiglit" .is tlie allowable standard for rrsidrntia) paints to .OIK. The hill would further anilmrize 445 million to the Department of Health. Educa tion and Welfare (HEW') for screen ing and detection programs In innercity areas and 55 million to the De partment of Ifuudng and Urban De velopment (HUD) to rarearch moth- ods for removing lead paint from resi dential structures. In introducing the hfll Mr. Kennedy admitted that the major enure of to day's lead poisoning b pre-World War II paints, containing more than SOfi white lead. However, ho reasoned that to "safeguard" against the disease In the future, all lead additives in interior paints must be "elimlnatad." Mr. Kennedy spoke of 'increasing evidence of the need to seek dm elimination of al but trace amounts of lead in paints used in houses." Ex plaining that 200 children die annuaL Iv from the disease he itreseed that "indeed, die greatest tragedy of child hood lead poisoning b that our so-' cfety has so far faded to prevent the disease even though we know how to do that" Robot A. Roland, Executive VicePresident of NPCA. testified before the subcommittee and termed a "com mon misconception the lielici that .ill manufacturers can easily remove the lead from their products. "Tlie proliImn of removing all Init trace nminintv uf lead from paint b a monumental one indeed," lie slated. To reach (lie .007 lead level, manufacturers would have l use "pharmaceutic-til tj pc" analysis of all their raw materials. "What all this could easily add up In is poorer performing products, dieting mure money to manufacture, and con sequently. more to buy in the market place." Calling tlie .067 standard ahum! impossible to enforce, Mr. Roland ex plained that much money and effort could be spent by Federal Stale and local officials in "trying to enforce an unreasonable lead limit that has, in no instance, heen shown to be neces sary for safety." Attacks on the use of small amounts of lead in modern paints, lie said, "do not do one thing to alleviate the serious problem of lead poisoning of children today." In fact, he addnl, these attacks hinder pro gress by "clouding tlie issue and tak ing focus off the heart of the matter." The present Lead-Based Paint Poisoning Prevention Act. which authorized $30 million over 1970 and 1971 for the treatment and detection of the disease, expires Jtme 30. SJ080 would provide an unlimited extension of the Act. Chicago Ctty'Council Enacts Ordinance on Lead Content The Chicago City Council enacted stringent ordinances February 24 re lating to the ure of lead and other heaw metals in paints. Effective July 1, tliese ordinances ben tiie sale or use of any coating con taining more than .061 lead on in terior surfaces or objects (toys, furni ture) exposed to children. Three same restrictions apply to any coating con taining more than .05* antimony, cadmium, mercury or selenium. Extendye labeling b also required under the new ordinances.
