BFGoodrich Chemical Group Borden Chemicals and Plastics Has Shah CMA 1.0 The October 29, 1991, Record of Conference Call was approved as written. 2.0 The Panel members agreed to submit their comments on the draft routing map to CMA by December 15, 1991. Mr. Jerry Meier will identify locations of railroad and community response teams on routes used by companies to transport vinyl chloride. Similar information for neighboring railroads, however, will not be collected. 3.0 The Panel members agreed to report to Dr. Has Shah annual railroad shipments that are on their Bill of Lading. All companies will submit their corrected information to Dr. Shah by December 15, 1991. Dr. Shah reported that Mr. John Klimavicz of Georgia Gulf, prior to the conference call, expressed an opinion to him that the 1992 Panel dues should be pro-rated based on the annual number of rail cars used to transport vinyl chloride rather than car-miles or ton-miles. His rationale for using the number of cars rather than car-miles is that the likelihood of the need for emergency response on the open road is significantly less than at switching points. The Panel members present, however, agreed that the 1992 budget should be pro-rated based on car-miles. Mr. Meier will provide to Dr. Shah the distance information between the origin and destination points for shipping vinyl chloride. Dr. Shah will then calculate the car-miles for each company based on shipment information received from member CMA 111737 ROCC Vinyl Chloride November 25, 1991 Page 2 companies, and re-calculate the 1992 pro-rata share of the budget for each participant in VCNet. 4.0 The Panel approved the VCNet Policy Statement that was sent to the members on November 12, 1991, with the correction of two typographical errors. The Operating Rules, sent to Panel members along with the Policy Statement, remain unchanged. Dr. Shah will send the final Policy Statement to Panel members in the next several days. The executed Policy Statements are due to CMA by December 15 1991. 5.0 The Panel reviewed the November 4, 1991, draft letter to Mr. Edward Mazzullo that Mr. Frank Sollman had prepared regarding the new hazardous material regulation (49 CFR Parts 171-180). The new regulation changes vinyl chloride as its proper shipping name to vinyl chloride, inhibited. This change is of concern to the U.S. shippers of vinyl chloride in that an inhibitor is not added to the monomer for purposes of domestic shipments and some international shipments. Mr. John Coburn will revise the draft letter to include the adverse impact of inhibiting vinyl chloride on polyvinyl chloride production and on the quality of the resulting polymer. Mr. Vergel Perry also will provide input on this issue to Mr. Coburn prior to finalizing the letter requesting the Department of Transportation to add to the list of regulated substances, "Vinyl Chloride." Such an inclusion would provide the U.S. shippers with the flexibility to use the correct shipping name for those shipments that do not contain a chemical inhibitor. Dr. Shah will distribute copies of the final letter to the Society of Plastics Industry, Vinyl Institute and Compressed Gas Association, and request these organizations to send similar letters to the U.S. Department of Transportation. 6.0 Mr. Perry reported that he has been able to negotiate with Lamar University the cost/attendee to $200.00 based on a minimum of 50 paid attendees. Dr. Shah reported that he has received information for preparing a draft brochure for the March 26 and 27, 1992, training workshop from Mr. Klimavicz. Dr. Shah will prepare a draft brochure based on the information received and send it to Mr. Klimavicz for comments prior to sending the brochure to the rest of the Panel members for comments. Dr. Shah will check with Mr. Bob Ondocsin and Ms. Alma Howard of CMA on the mechanics and administration of organizing a workshop. 7.0 Mr. Coburn requested that all Panel members inform Mr. Perry as to how many people from their companies are anticipated to attend the training workshop on March 26 and 27, 1992. This information is critical in determining if an additional workshop should be planned. CMA 111738 ROCC Vinyl Chloride November 25, 1991 Page 3 8.0 The Panel agreed to limit the 24-hour emergency contact numbers to a minimum, possibly one per company. The emergency number should be the one which can direct the incoming calls to a person who can answer questions regarding the availability of empty railcars for transferring vinyl chloride in cases of emergencies. Dr. Shah will revise the November 6, 1991, list of emergency contact numbers and send the revised list to Panel members. 9.0 The 1992 Panel budget will be discussed at the next Panel meeting. 10.0 The next Panel meeting will be on January 21, 1992, at the Intercontinental Hotel, in Houston, Texas. 11.0 The Conference Call ended at 5:45 EST.
