Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected 1349 West Peachtree Street, N.W., Suite 2000 Atlanta, Georgia 30309 Inspection Date: June 12, 2024 3601679012 LAT: 33.7916 LON: -84.3874 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspectors Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on June 12, 2024, at 1349 West Peachtree Street, Northwest, Suite 2000, in Atlanta, Georgia 30309 (the Facility). The unannounced inspection was conducted by Pamela Storm and Tony Spann who possess EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The inspectors discovered that renovation had occurred at the Facility by obtaining a copy of Permit #BB-202401894 (for renovations to suite 2000) issued by the City of Atlanta on March 4, 2024. The permit was issued for commercial interior alterations to suite 2000, including selective interior alterations and the replacement of partitions and finishes. The permit specifies Merit Construction Company, 2400 Pleasantdale Road, Atlanta, Georgia 30340 as the general contractor and Lincoln Property Company, 3340 Peachtree Road, Atlanta, Georgia 30326 as the owner. The renovation activity had been completed as of the time of this inspection. The purpose of the inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the renovation activity conducted at the Facility. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; demolition and/or renovation/abatement notices sent to the State; and other relevant information concerning renovation/demolition activities at regulated facilities. This inspection was conducted based on the aforementioned permit for renovation activity at the Facility. Facility Information The Facility is a business office. He stated that Merit Construction Company had completed the permitted renovations which included the removal and replacement of flooring and a few interior walls. Chris Tanksley did not believe that an asbestos survey was performed prior to the renovations. He explained that no materials were disturbed "that looked suspect." Chris Tanksley provided contact information for Richard Poole with Merit Construction Company to the EPA inspectors for them to obtain more information about the renovation of the Facility. Conclusion EPA will discuss the renovation activity with the owners/operators to determine if the requirements of the Asbestos NESHAP were met when conducting the renovations.
