I met with of at the Opening Conference. I presented my credentials to and informed her that this was an EPA inspection to determine compliance with the Clean Water Act (CWA). The scope of the inspection is a full compliance evaluation. FACILITY DESCRIPTION The unpermitted facility is a sanctuary with one barn, and is located at Arkansas. The facility houses 94 for the purpose of extending the animals' lives. The facility did not have a Nutrient Management Plan (NMP) at the time of the inspection. The Water Quality Indicators (WQI) identified this facility to be near the watershed which is impaired for Dissolved Oxygen (DO), pH, and turbidity. The are fed alfalfa and Bermuda grass that is stored in the barn. Section II - OBSERVATIONS x Large, uncovered manure piles were observed on the northern edge of the property line without cover. The topographical landscape appeared to have runoff head to a small pond on the property. (Photo 1, Appendix 1). x A small pond at the center of the property appeared to receive runoff from the uphill runoff (Photo 2, Appendix 1). x The heavily vegetated path from the uphill uncovered manure piles to the pond (Photo 3, Appendix 1) x A manure pile was observed outside of containment near the horse barn (Photo 4, Appendix 1). x The burial site was observed to be clean and well covered with dirt. x Feed for the animals was kept under cover in the horse barn. Section III - AREAS OF CONCERN x Manure piles were observed outside containment where they would be susceptible to rain runoff (Appendix 1, Photo 1 and 4) Nutrients and bacteria from these manure piles can lead to algae blooms in downstream waterbodies such as [40 CFR 122.42(e)(1)(vi)]. x EPA received a citizen complaint regarding the exposed manure piles. 2 Inspection Date 09/19/2025 Closing Conference EPA Region 6 inspector Paul Juarez conducted a closing conference at at 12:54pm on September 19th, 2025, for the inspection. During the closing conference, Inspector Paul Juarez reviewed the two Areas of Concern noted during the inspection, fielded questions from facility personnel, and provided information about the next steps in the inspection process.
