Under Section 1423(c) of the SDWA, 42 U.S.C. 300h-2(c), the EPA is authorized to pursue actions assessing civil penalties and corrective actions for compliance for various violations of the SDWA. The EPA provides notice of the proposed assessment of a civil penalty and corrective actions for compliance pursuant to 42 U.S.C. 300h2(c)(3)(B). In this action, EPA is issuing a Proposed Administrative Order under its authority pursuant to Section 1423 of the SDWA against Respondent. The Proposed Administrative Order proposes to order the Respondent to successfully demonstrate the mechanical integrity of the injection well, plug the well, or convert the well to production use. The injection well is known as Well No. 10-11 and is located in Osage County, Oklahoma. Regulations at 40 C.F.R. 147.2916 require the owner or operator of a new Class II injection well, or any other Class II injection well required to have a permit in the Osage Mineral Reserve, to comply with the requirements of 40 C.F.R. 147.2903, and 147.2920. The Proposed Administrative Order alleges that the Respondent violated regulations at 40 C.F.R. 147.2903(b) and 147.2920(b), and Part I.B. of Respondent's permit by maintaining Well No. 4 in a manner that could allow the movement of fluid that contains contaminants into an underground source of drinking water and by failing to successfully demonstrate mechanical integrity. EPA is seeking comment on this Proposed Administrative Order pursuant to Section 1423(c) of the Safe Drinking Water Act. EPA will consider all comments received in determining its final action.
