FINDING OF VIOLATION
The U.S. Environmental Protection Agency finds that Carmeuse Lime, Inc. (Carmeuse) has violated Section 112 of the Clean Air Act (CAA), 42 U.S.C. 7412, at its Grand River Operation at 15 Williams Street, Grand River, Ohio (Facility). Specifically, Carmeuse has violated the National Emission Standards for Hazardous Air Pollutants for Lime Manufacturing Plants (LMPs) at 40 C.F.R. Part 63, Subpart AAAAA (LMP NESHAP) as follows:
Statutory and Regulatory Authority
1. Section 112(d) of the CAA, 42 U.S.C. 7412(d), requires the EPA to establish emission standards for each category or subcategory of major sources and area sources of hazardous air pollutants (HAPs) listed for regulation under Section 112(c) of the CAA. These emission standards are known as the National Emission Standards for Hazardous Air Pollutants (NESHAP). The purpose of the NESHAP is to apply maximum achievable control technology to each source category for the reduction of HAP emissions.
2. On January 5, 2004, the EPA promulgated the LMP NESHAP at 40 C.F.R. Part 63, Subpart AAAAA. 69 Fed. Reg. 416 (Jan. 5, 2004).
3. An owner or operator of an LMP that is a major source, or that is located at, or is part of, a major source of HAP emissions is subject to the LMP NESHAP, unless the LMP is located at a kraft pulp mill, soda pulp mill, sulfite pulp mill, beet sugar manufacturing plant, or only processes sludge containing calcium carbonate from water softening processes, as set forth at 40 C.F.R. 63.7081(a).
4. The LMP NESHAP, at 40 C.F.R. 63.7081(a)(1), states that an LMP is an establishment engaged in the manufacture of lime product (calcium oxide, calcium oxide with magnesium oxide, or dead burned dolomite) by calcination of limestone, dolomite, shells or other calcareous substances.
5. The LMP NESHAP, at 40 C.F.R. 63.7081(a)(2), states that a major source of HAP is a plant site that emits or has the potential to emit any single HAP at a rate of 9.07 megagrams (10 tons) or more per year or any combination of HAP at a rate of 22.68 megagrams (25 tons) or more per year from all emission sources at the plant site.
6. The LMP NESHAP applies to, among other affected sources, each existing or new lime kiln located at an LMP that is a major source of HAP. See 40 C.F.R. 63.7082(a).
7. The LMP NESHAP, at 40 C.F.R. 63.7082(f), states that an existing lime kiln is any lime kiln, and (when complying with particulate matter (PM) emissions limitations) its associated lime cooler, that does not meet the definition of a new kiln of 40 C.F.R. 63.7082(b) and (c):
a. 40 C.F.R. 63.7082(b) states that, for purposes of complying with the PM emissions limitations of the LMP NESHAP, a new lime kiln is a lime kiln, and (if applicable) its associated lime cooler, for which construction or reconstruction began after December 20, 2002, if the applicability criteria in 40 C.F.R. 63.7081 were met at the time the owner or operator began construction or reconstruction.
b. 40 C.F.R. 63.7082(c) states that, for purposes of complying with the HCl, mercury, organic HAP, and dioxins/furans emissions limitations of the LMP NESHAP, a new lime kiln is a lime kiln (only) for which construction or reconstruction began after January 5, 2023, if the applicability criteria in 40 C.F.R. 63.7081 were met at the time the owner or operator began construction or reconstruction.
8. Affected sources under the LMP NESHAP must meet the emission limitations (including operating limits) set forth at 40 C.F.R. 63.7090.
9. The LMP NESHAP, at 40 C.F.R. 63.7090(b), requires the owner or operator of an affected lime kiln to meet each applicable operating limit in Table 3 to the LMP NESHAP.
10. Table 3 of the LMP NESHAP, at 1., requires the owner or operator of each lime kiln and lime cooler (if there is a separate exhaust to the atmosphere from the associated lime cooler) equipped with a fabric filter (FF) to maintain and operate the FF such that the bag leak detector system (BLDS) or PM detector alarm condition does not exist for more than 5 percent of the total operating time in a 6-month period; and comply with the requirements in 40 C.F.R. 63.7113(d) through (f) and Table 6 of the LMP NESHAP. In lieu of a BLDS or PM detector, Table 3 of the LMP NESHAP, at 1., requires the owner or operator to maintain the FF such that the 6-minute average opacity for any 6minute block period does not exceed 15 percent; and comply with the requirements in 40 C.F.R. 63.7113(f) and (g) and Table 6 of the LMP NESHAP.
11. Table 3 of the LMP NESHAP, at 3., requires the owner or operator of each lime kiln equipped with an ESP to install a PM detector and maintain and operate the ESP such that the PM detector alarm is not activated and alarm condition does not exist for more than 5 percent of the total operating time in a 6-month period, and comply with 40 C.F.R. 63.7113(e); or, to maintain the ESP such that the 6-minute average opacity for any 6-minute block period does not exceed 15 percent, and comply with the requirements in 40 C.F.R. 63.7113(g); and comply with the requirements in 40 C.F.R. 63.7113(f) and Table 6 of the LMP NESHAP.
12. Table 3 to the LMP NESHAP thus allows an owner or operator to comply with operating limits for each lime kiln equipped with an FF or an ESP, except during startup and shutdown, by maintaining the FF or ESP such that the 6-minute average opacity for any 6-minute block period does

not exceed 15 percent while also complying with, among other things, the requirements in Table 6 to the LMP NESHAP.
13. The LMP NESHAP, at 40 C.F.R. 63.7121(a), requires an owner or operator to demonstrate continuous compliance with each applicable emission limitation in Table 3 to the LMP NESHAP according to the methods specified in Table 6 to the LMP NESHAP.
14. Table 6 to the LMP NESHAP, at 4., requires the owner or operator of each lime kiln that is equipped with an FF or an ESP and that uses a continuous opacity monitoring system (COMS) as the monitoring device for maintaining and operating the FF or ESP such that the average opacity for any 6minute block period does not exceed 15 percent to demonstrate continuous compliance by:
a. Installing, maintaining, calibrating, and operating a COMS as required by 40 C.F.R. Part 63, Subpart A, General Provisions and according to PS-1 of Appendix B to 40 C.F.R. Part 60, except as specified in 40 C.F.R. 63.7113(g); and
b. Collecting the COMS data at a frequency of at least once every 15 seconds, determining block averages for each 6-minute period, and demonstrating for each 6-minute block period the average opacity does not exceed 15 percent.
15. The LMP NESHAP, at 40 C.F.R. 63.7090(c), requires the owner or operator of an affected lime kiln that commenced construction or reconstruction on or after the relevant compliance date specified in 40 C.F.R. 63.7083(e) [sic] to meet each applicable startup and shutdown period emission limit in Table 2 to the LMP NESHAP.
16. The LMP NESHAP, at 40 C.F.R. 63.7083(g)(1), indicates that the compliance date is January 20, 2021, for the revised requirements promulgated at 40 C.F.R. 63.7090, 63.7100, 63.7112, 63.7113, 63.7121, 63.7130, 63.7131, 63.7132, 63.7140, 63.7141, 63.7142, and 63.7143 and Tables 2, 3, 4, 5, 7, 8 and 9 (with certain exceptions not applicable here) to the LMP NESHAP, if the affected source commenced construction or reconstruction on or before September 16, 2019.
17. Table 2 of the LMP NESHAP, at no. 1, prohibits emissions from all new and existing lime kilns and their associated coolers equipped with an FF or an ESP from exceeding 15 percent opacity (based on startup block average) during each startup. It provides that an owner or operator has demonstrated compliance, if after following the requirements in 40 C.F.R. 63.7112 the owner or operator has:
a. Installed, maintained, calibrated and operated a COMS as required by the general provisions of 40 C.F.R. Part 63, Subpart A and according to Performance Specification (PS)-1 of appendix B to 40 C.F.R. Part 60, except as specified in 40 C.F.R. 63.7113(g)(2);
b. Collected the COMS data at a frequency of at least once every 15 seconds, determining block averages for each startup period and demonstrating for each startup block period the average opacity does not exceed 15 percent.
18. Table 2 of the LMP NESHAP, at 3., prohibits emissions from all new and existing lime kilns and their associated coolers equipped with an FF or an ESP from exceeding 15 percent opacity

(based on 6-minute average opacity for any 6-minute block period does not exceed 15 percent) during shutdown. It provides that an owner or operator has demonstrated compliance, if after following the requirements in 40 C.F.R. 63.7112 the owner or operator has:
a. Installed, maintained, calibrated and operated a COMS as required by the general provisions of 40 C.F.R. Part 63, Subpart A and according to PS-1 of appendix B to 40 C.F.R. Part 60, except as specified in 40 C.F.R. 63.7113(g)(2);
b. Collected the COMS data at a frequency of at least once every 15 seconds, determining block averages for each 6-minute period and demonstrating for each 6-minute block period the average opacity does not exceed 15 percent.
19. Table 2 to the LMP NESHAP thus prohibits the owner or operator of a lime kiln equipped with an FF or an ESP from exceeding 15 percent opacity (based on startup period block average during startup or based on 6-minute average opacity for any 6-minute block period during shutdown).
20. The LMP NESHAP, at 40 C.F.R. 63.7132(a)(2)(i), requires the owner or operator of an affected lime kiln that is subject to a standard during startup that differs from the standard applicable at other times to keep certain startup records. These startup records establish the duration of the startup period for the purpose of determining a startup period block average.
21. The LMP NESHAP, at 40 C.F.R. 63.7100(a), states that prior to the relevant compliance date specified in 40 C.F.R. 63.7083(e) [sic], the owner or operator must be in compliance with the LMP NESHAP emission limitations (including operating limits) at all times, except during periods of startup, shutdown, and malfunction (SSM); and that on and after the relevant compliance date, the owner or operator must be in compliance with the applicable emission limitations (including operating limits) at all times. The owner or operator may operate outside of the established operating parameter limit(s) during performance tests in order to establish new operating limits.
22. Section 112(i)(3) of the CAA, 42 U.S.C. 7412(i)(3), and 40 C.F.R. 63.4 prohibit the owner or operator of any source from operating such source in violation of any NESHAP applicable to the source.
Statement of Facts
Carmeuse Grand River Operation
23. The Facility is an LMP that uses lime kilns to produce lime product from limestone or other calcareous material by calcination.
24. The Facility is not located at a kraft pulp mill, soda pulp mill, sulfite pulp mill, beet sugar manufacturing plant, and the Facility does not process sludge containing calcium carbonate from water softening processes.
25. The Facility is an LMP site that emits or has the potential to emit any single HAP at a rate of 9.07 megagrams (10 tons) or more per year or any combination of HAP at a rate of 22.68 megagrams (25 tons) or more per year from all emission sources at the plant site and is therefore a major source of HAP under 40 C.F.R. 63.7081(a)(2).

26. Carmeuse is subject to the LMP NESHAP pursuant to 40 C.F.R. 63.7081(a) because it owns and operates the Facility.
27. The Facility includes two rotary lime kilns, designated as Lime Kilns #4 and #5, that were constructed or reconstructed before December 20, 2002.
28. Lime Kiln #4 and Lime Kiln #5 are existing Lime Kilns under 40 C.F.R. 63.7082(f), since they do not meet the definition of a new kiln in 40 C.F.R. 63.7082(b) and (c).
29. Lime Kilns #4 and #5 are affected sources under the LMP NESHAP in accordance with 40 C.F.R. 63.7082(a) because those units are existing lime kilns at an LMP that is a major source of HAP emissions.
Carmeuse Grand River Title V Permitting
30. The Ohio Environmental Protection Agency (OEPA) issued Title V Permit Number P0118764 to Carmeuse effective August 2, 2017, under its approved CAA permit program. With a minor October 30, 2017 modification, this 2017 permit, renumbered Permit Number P0123524 (the 2017 Title V Permit) continued in effect under Ohio law until OEPA issued Carmeuse a new Title V Permit effective February 14, 2024, Permit Number PO131727 (the 2024 Title V Permit), as Carmeuse had submitted a timely application for renewal. The 2024 Permit is scheduled to expire on February 14, 2029. Both the 2017 Title V Permit and the 2024 Title V Permit incorporated LMP NESHAP requirements by reference.
31. At all relevant times, Conditions C.2.b)(1)f and C.3.b)(1)f, for Kiln #4 and Kiln #5, respectively, of both the 2017 Title V Permit and the 2024 Title V Permit impose the requirement that visible particulate emissions shall not exceed 15% opacity as a 6-minute average.
32. At conditions C.2.b)(1)f and C.3.b)(1)f, the earlier 2017 Permit had identified what are now Tables 3 and 6 to the LMP NESHAP, following the July 24, 2020 revisions to the LMP NESHAP (85 Fed. Reg. 44977), as Table 4 and 5.
Inspection and Information Request
33. On February 7, 2024, the EPA conducted an unannounced CAA inspection of the Facility.
34. Pursuant to Section 114(a) of the CAA, 42 U.S.C. 7414(a), the EPA issued an Information Request to Carmeuse on June 14, 2024 (June 2024 Request).
35. On July 29, 2024, Carmeuse provided a response to the June 2024 Request (July 2024 Documents).
36. The information gathered from the February 7, 2024 inspection and from reviewing the July 2024 Documents includes, but is not limited to, the facts set forth below.
Opacity Limits for Lime Kilns #4 and #5
37. Carmeuse operates Lime Kilns #4 and #5 24 hours per day, 7 days per week, 365 days per year, except as otherwise reported to OEPA on a quarterly basis (Quarterly Reports).

38. Lime Kiln #4, which is controlled by an FF, and Lime Kiln #5, which is controlled by an ESP, share a common stack equipped with a COMS.
39. Carmeuse's method for complying with the LMP NESHAP operating limits set forth at 40 C.F.R. 63.7090(b) and (c) includes, among other things, maintaining the FF for Lime Kiln #4 and the ESP for Lime Kiln #5 such that the 6-minute average opacity at the common stack for any applicable block period does not exceed 15 percent.
40. Pursuant to 40 C.F.R. 63.7100(a), the 15 percent opacity limit did not apply to Lime Kilns #4 and #5 during periods of SSM that occurred before January 20, 2021.
41. Carmeuse did not provide the requested records of startup periods set forth at 40 C.F.R. 63.7132(a)(2)(i) in the July 2024 Documents.
42. In its narrative response to Request 3 of the June 2024 Request, Carmeuse stated that, "[the Facility] does not follow an opacity standard during Startup periods which differs from that applicable at other times." That narrative response said Carmeuse adheres to an opacity standard of 15% over a 6-minute block average during all times Kilns #4 or #5 are operational, consistent with the 2024 Title V Permit.
Opacity Exceedances
43. Carmeuse submits signed and certified Quarterly Reports to the OEPA Division of Air Pollution Control Northeast District Office that provide information on opacity exceedances and COMS downtime for the Lime Kilns #4 and #5 common stack.
44. In the Quarterly Reports, Carmeuse reported the number of minutes it exceeded the 15 percent opacity limits in Tables 2 and 3 to the LMP NESHAP for the Lime Kilns #4 and #5 common stack. The reported exceedances are listed in Attachment A to the FOV and summarized as follows:

Carmeuse reported these exceedances as exempt and did not include them in the Quarterly Report exceedance summation. Therefore, the event is not included as an exceedance in this FOV. 7 Carmeuse has asserted a claim that 66 minutes of exceedance reported to be caused by "rain events" on October 7, October 24, and November 2 of 2021 are exempt. Pursuant to 40 C.F.R. 63.7090(b) and 63.7100(a), the opacity limit applies at all times (except startup and shutdown periods that are addressed elsewhere in the LMP NESHAP). These exceedances did not occur during startup or shutdown; therefore, the 66 minutes was included as an exceedance in this FOV. 8 The Excess Emissions Report Summary Form reported 210 minutes, but only 192 minutes were listed in the Opacity Exceedances & Downtime Summary Table. 9 The Excess Emissions Report Summary Form reported 654 minutes, but only 636 minutes were listed in the Opacity Exceedances & Downtime Summary Table. 10 The Excess Emissions Report Summary Form reported 366 minutes, but only 354 minutes were listed in the Opacity Exceedances & Downtime Summary Table. 11 The Opacity Exceedances & Downtime Summary Table lists three 6-minute averages on May 1, 2023 with the same start time (20:59) in a series of consecutive exceedances reportedly caused by "Kiln 5 ESP bank down." This FOV assumes that the listed start times are erroneous and counts all three instances towards the total, consistent with the accounting in the Excess Emissions Report Summary Form.

45. As set forth in Attachment A, Carmeuse reported causes for the opacity exceedances that include:
a. 2,370 minutes of exceedances due to unknown causes;
b. 1,620 minutes of exceedances caused by failures or maintenance at the ESP used to control Lime Kiln #5;
c. 1,596 minutes of exceedances caused by cleaning and ash management (e.g., "K5 shooting," "stack cleaning," "Kiln 5 Cleanout," "cleaning cooler grates," etc.); and
d. 444 minutes of exceedances caused by failures or maintenance at the baghouse used to control Lime Kiln #4.
COMS Downtime
46. In the Quarterly Report for Facility operation during the second quarter of 2020, Carmeuse reported 8,688 minutes of COMS downtime from May 1, 2020 through May 7, 2020 due to a failure of the monitor at the Lime Kilns #4 and #5 common stack.
47. In the Quarterly Report for Facility operation during the second quarter of 2020, Carmeuse certified that source operating time in May of 2020 was equal to the total number of minutes available in the month of May of 2020.
48. Carmeuse provided opacity data for the Lime Kilns #4 and #5 common stack collected at a frequency of 15 seconds in the July 2024 Documents (15 Second Data).
49. The 15 Second Data had a recorded opacity value that did not deviate from 1.915 0.005% for 4,344 consecutive minutes beginning at 9:24 a.m. on May 12, 2020.
50. The 4,344 minute period described by paragraph 49 above, corresponds to unreported COMS downtime because the measured variance (310-6) was significantly smaller than COMS variance during normal operation over similar time periods.
51. In the Quarterly Report for Facility operation during the third quarter of 2023, Carmeuse reported 1,560 minutes of COMS downtime on November 29 and 30, 2023 due to a failure of the system to log data.
Violations
52. Carmeuse exceeded the 15 percent average opacity limit at Tables 2 and 3 to the LMP NESHAP for the Lime Kilns #4 and #5 common stack for 7,938 minutes between April 3, 2020 and September 23, 2024, in violation of 40 C.F.R. 63.7090(b) and (c).
53. Carmeuse failed to demonstrate continuous compliance with each operating limit in Table 3 to the LMP NESHAP according to the methods specified in Table 6 to the LMP NESHAP by failing

to collect COMS data at the Lime Kilns #4 and #5 common stack for 14,592 minutes during May 1-15, 2020 and August 29-30, 2023, in violation of 40 C.F.R. 63.7121(a).
54. CAA.
Pursuant to 42 U.S.C. 7412(i)(3), the violations described above are violations of the
Environmental Impact of Violations
55. These violations have caused or can cause excess emissions of metal HAPs, including, but not limited to, antimony, arsenic, beryllium, cadmium, chromium, lead, manganese, mercury, nickel, and selenium.
56. Metal HAP emissions are associated with a variety of adverse health effects, including chronic health disorders (e.g., irritation of the lung, skin, and mucus membranes; effects on the central nervous system; cancer; and damage to the kidneys), and acute health disorders (e.g., lung irritation and congestion, alimentary effects such as nausea and vomiting, and effects on the kidney and central nervous system).
