The SPI Steering Committee voted 5 to 1 to support the petitioners (Firestone and Union Carbide) on their writ of certiorari in the Supreme Court. The VCM/PVC producers group voted 12 to 6 to support it also. PPG voted yes. The meeting copy of this writ is forwarded to F. J. Trunzo, Or. In discussing this, the attornies fur the respondents solicited an opinion from the Harvard Law School. It was their judgment that the chance of it being granted was 20 percent and chances of success were 65 percent. Another prestigious law firm judged the chances to be 10-20 percent and 60 percent. ' EPA activities were discussed. The proposed plan of action was changed as fa result of the retention of W. Ruckelshaus as special counsel. Accordingly^ the February 19 meeting with Russell Train was canceled. Additional prepara tions were made for the Technical Conmtttee meeting with EPA at Research Triangle on February 25. Various items of review and discussion were directed towards developing a concensus on: the options on monitoring (hopefully, a system like that for mercury will be agreed upon); point sources to monitor (again, .Ruckelshaus cautioned against giving EPA any numbers--th^y will only half or quarter them); EPA monitoring program has been gathering data at a number of locations (at the Goodrich Louisville plant, 72 of 80 samples were less than 0.04 ppm). Ruckelshaus will request and expects to develop a number of meetings with the Research Triangle group working on the regulation so as to develop a cooperative effort. He was of the opinion that this will probably be a technology standard, i.e. method of control may be spelled out. A brief report by Thomas Smith covered the activities of the ad hoc distribution group dealing with transportation, packaging, and labeling. The cancer-suspect agent labeling required by OSHA is causing concern to the truckers, as expressed by ATA. The maritime association has indicated that the ocean shipping people will not handle a cancer-suspect "agent. Consideration was given to going to OSHA after they have a new assistant secretary.
