Dear Tony:
I am writing in reference to the above-captioned matter.
Let this letter serve an acknowlegement of our conversation of
March 16, 1989. In that conversation we discussed that we would
obtain an activities check on
to determine what
her marital and physical condition is at this point. This will
need to be done before any final decision is made for how we
shall proceed for final disposition of this case.
Also, Attorney Robert Mueller will be discussing the case with the petitioner's attorney to obtain some hardcore numbers that we can use to evaluate the case. I have discussed with him that no offers or agreement on final disposition should be made until we have (1) your approval, (2) the results of the activities check.
In reviewing my file, I note this case now needs to be reported to the excess carrier, however, I have no information as to who the excess carrier was at the time of this incident. Again, this incident occurred April 15, 1981, and I am requesting that you provide me with who the excess carrier was at that time, what their policy number was, and what the self-insured retention level is.
Thanks for your cooperation and please contact me when you receive this letter, as the case needs to be reported to the excess carrier as soon as possible in order to protect your rights to recover.
