I. Introduction
The U.S. Environmental Protection Agency, Region III ("EPA") received information from the U.S. Army Corps of Engineers, Norfolk District ("USACE") notifying the EPA that USACE representatives observed ongoing and/or completed activities involving the potential discharge of dredged or fill material into waters of the United States on the Site related to the expansion of the campground. On February 28, 2023, the EPA notified the owner, Sun Tall Pines Harbor RV, LLC, that the case had been referred from the USACE and the EPA is the lead enforcement agency for this new construction activity under Section 404 of the Clean Water Act ("CWA").
This inspection was conducted by the EPA to evaluate the compliance of the Site with Section 404 of the CWA. The inspection date was coordinated with Mr. Dante Iocona ("Mr. Iocona"), the Regional Operations Manager with Blue Water Hospitality ("Blue Water"). Subsequent email correspondence on March 13, 2023, confirmed the date and time of the inspection. EPA assigned this inspection Unique Project Identification # 3E23WW035A.
A. Site Identification
The inspection was conducted at Sun Outdoors Chesapeake Bay, located at 8107 Tall Pines Lane (Tax Map # 24-A-129 and Parcel 02400A000012900) in Temperanceville, Virginia ("Site"). The Site is owned by Sun Tall Pines Harbor RV, LLC and is an approximately 80-acre recreational campground situated on the waterfront of the Pocomoke Sound. The Site is further identified in map provided in Attachment 1.
B. Weather and Environmental Conditions
The weather conditions for the day of the inspection, Wednesday, April 5, 2023, were clear and sunny with a recorded high temperature of 88 F at the Ashland Hanover Municipal Airport Station (USW00093775). In the 6-day period preceding the inspection there were two days of recorded rainfall at Station US1VAAC0007, according to the National Oceanic & Atmospheric Administration's Record of Climatological Observations as shown in Table 1 below.

C. Inspection Opening Conference
The EPA inspectors arrived onsite via Tall Pines Lane at approximately 8:50 AM. The inspection team parked and entered the Welcome Center where they were directed by reception to a conference room where Blue Water representatives were waiting.
The Opening Conference began at approximately 8:55 AM with introductions. The EPA inspectors, Katelyn Almeter and Robert George, displayed their credentials to Mr. Iocona and Ms. Kim Scott ("Ms. Scott") at the outset of the inspection and explained that the purpose of the inspection was to document the conditions on the Site, where recent earth-moving and construction activities occurred. Additionally, the inspectors would collect data and photographs to observe the status of the Site's compliance with Section 404 of the CWA.
Mr. Iocona stated that Blue Water purchased the Site in November 2021 and operates the campground. He stated that while there were not any active construction projects onsite, approximately 40 truckloads of fill were recently placed to the southeast of the Welcome Center for use as a parking/storage area. He also stated that there were plans to expand the septic system and to implement beach replenishment along the waterfront.
The EPA inspectors informed Mr. Iocona that an inspection report will be prepared following the inspection. Based on EPA's process, the inspection report is expected to be finalized within 60 days of the inspection and will be distributed to the inspection attendees thereafter. The Opening Conference concluded at 9:05 AM and the attendees walked outside to begin the inspection. At 9:10 AM, Mr. David Knepper, a biologist with the USACE, Norfolk District, joined the inspection team.

II. Site Activity
On May 29, 2019, USACE representatives observed ongoing and/or completed activities involving the potential discharge of dredged or fill material into waters of the United States on the Site related to the expansion of the campground. The EPA was contacted by the USACE and was informed that an after-the-fact permit was issued for beach nourishment of the northern portion of the Site in 2008 (NAO-2008-02241). Please note that this permit expired in 2013 and is no longer valid. The USACE did not have any record of any other permit(s) for earth-moving or filling activity in aquatic resources on other portions of the Site. This inspection was conducted to observe the status of compliance at the Site in light of information provided to the EPA regarding recent potential work conducted in wetlands.
III. Observations
Following the Opening Conference, the inspectors traveled to the southeast of the Welcome Center where Mr. Iocona had stated that approximately 40 truckloads of fill were recently placed. The inspectors observed a rectangular area where brown sandy fill had been discharged (Attachment 2, DSCN4601-DSCN4604). Henceforth, this area will be referred to as Area of Concern ("AOC") 1.
Soil boring Bor-1 was documented at the southwestern corner of AOC-1 at 37.929544, 75.653214 (See Site Figure [Attachment 1] and photos DSCN4605-DSCN4607): [0-8 inches] mixed matrix 80% 7.5YR 5/6 sandy fill and 20% 7.5YR 4/6 sandy fill; [8-11 inches] root mat and native soil surface encountered, 10YR 3/1 sand with 2% 2.5YR 3/6 oxidized rhizospheres; [11-19+ inches] 10YR 3/1 sand with 5% 2.5YR 3/6 redoximorphic features. The observed native soil profile met the technical definition of a hydric soil (Indicator S5). Vegetation was not observed within AOC-1 as all three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by the discharge of fill.
The inspectors walked east and encountered a linear ditch bordering the property, oriented from north to south. The ditch possessed an ordinary high-water mark, flow, and the bed was indicative of regular flow. At the time of inspection, the ditch was full of water with discernable flow toward the Pocomoke Sound. Sandy fill was observed within this ditch (DSCN4608 and DSCN4609). Soil boring Bor-2 was documented immediately to the west of the ditch at the northeastern corner of AOC-1 at 37.929619, -75.652603 (DSCN4610- DSCN4612): [0-10 inches] mixed matrix 80% 7.5YR 5/2 sandy fill and 20% 7.5YR 5/8 sandy fill; [10-11 inches] root mat and native soil surface encountered, 10YR 2/1 organic peat; [11-14+ inches] 10YR 3/1 sandy loam with 5% 2.5YR 3/6 oxidized rhizospheres. The observed native soil profile met the technical definition of a hydric soil (Indicator S5). Vegetation was not observed within AOC-1 as all three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by the discharge of fill. AOC-1 was further documented, and fill was observed butting up against multiple tree trunks (DSCN4613- DSCN4615).

The inspection team walked to the north a field (DSCN4616 and DSCN4617), then traveled west to where a septic tank was recently installed (DSCN4618- DSCN4619). The inspection team then traveled to the southeast, where publicly available 2021 aerial imagery indicated earthmoving or filling activity may have occurred. The inspectors observed two oblong areas where fill had been placed (DSCN4620-DSCN4626). Henceforth, this area will be referred to as AOC-2.
Soil boring Bor-3 was extracted from AOC-2 at 37.929972, -75.655328 (DSCN4627DSCN4630): [0-3.5 inches] mixed matrix 80% 7.5YR 6/3 sandy fill and 20% 10YR 4/1 sandy loam; [3.5-13 inches] native soil surface encountered, 10YR 4/1 sandy loam with 15% 2.5YR 3/6 oxidized rhizospheres. The observed native soil profile met the technical definition of a hydric soil (Indicator S5). Bor-3 was collected from mowed field which was dominated by turfgrass: Bermudagrass (Cynodon dactylon) and annual bluegrass (Poa annua). Vegetation in this area was altered by regular maintenance and the soil was impacted by the discharge of fill. While AOC-2 was further documented, including a ditch to the south (DSCN4631-DSCN4637), Ms. Scott stated that in December 2022 a storm inundated the eastern portion of the Site and Mr. Iocona followed up that material was placed in that area in January 2023 because maintenance trucks had difficulty with access.
The inspection team then traveled to this area on the central-eastern portion of the Site where a road constructed of fill material was documented (DSCN4639-DSCN4640). Piles of logs, firewood, mulch and general woody refuse were also observed. Additionally, the area was used to store miscellaneous items associated with the operation, landscaping equipment and materials (DSCN4641- DSCN4648). Henceforth, this area will be referred to as AOC-3. Some miscellaneous items were scattered to the east of the Site throughout the forest. Mr. Iocona stated that this was due the recent flooding event in December 2022.
The inspection team then walked to the north and encountered a road, which was constructed of sand above grade and was oriented south to north. Henceforth, this area will be referred to as AOC-4. Soil boring Bor-4 was extracted the southern extent of the road at AOC-4 at 37.932928, -75.652858 (DSCN4651): [0-1.5 inches] 7.5YR 6/4 sandy fill; [1.5-3.5 inches] 10YR 3/1 compacted sandy loam; [3.5-6 inches] 7.5YR 6/4 sandy fill; [6-14 inches] 10YR 3/1 sandy loam with 5% 2.5YR 6/4 redoximorphic features.
The road continued northward, and large fill piles were observed on the road (DSCN4652DSCN4655). Ms. Scott stated that the piles were comprised of spoils excavated from the where the new septic system was recently installed (See above at Section III, Paragraph 4 [pg. 5] and photos DSCN4618-DSCN4619). The inspection team continued northward on the road, and it appeared that some of the sand used to construct the road had spilled into a ditch, which ran parallel east of the road (DSCN4656- DSCN4661). This was a downstream section of the ditch abutting AOC-1.

Soil boring Bor-5 was extracted from the northern extent of the road at AOC-4 at 37.934047, 75.652081 (DSCN4663): [0-9 inches] mixed matrix 90% 7.5YR 5/4 sandy fill and 10% 7.5YR 6/6 sandy fill; [9-10 inches] 10YR 2/1 native soil surface comprised of black organic peat and root mat; [10-18+ inches] 10YR 3/1 sandy loam with 5% 2.5YR 5/4 redoximorphic features. The observed native soil profile met the technical definition of a hydric soil (Indicator S5). All three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by the discharge of fill.
The inspection team then walked west to a reference area that was forested and collected Bor-6 at 37.933881, -75.652378 (DSCN4664-DSCN4666): [0-4 inches] 10YR 2/1 black organic peat and root mat; [4-12 inches] 10YR 3/1 sandy clay; [12-18+ inches] 10YR 4/1 sandy clay with 5% 2.5YR 4/6 redoximorphic features. The observed soil profile met the technical definition of a hydric soil (Indicator S1). Primary indicators of hydrology were observed. For example, the soil was saturated, and the water table was seeping into the boring at a depth of 15 inches. The vegetation community was dominated by mature loblolly pine (Pinus taeda) in the tree stratum. The community did not contain a sapling or shrub strata. The herbaceus stratum contained a few individual whorled pennywort (Hydrocotyle verticillata). This area met the technical definition of a wetland as hydric soils, wetland hydrology, and a hydrophytic vegetation were observed. The inspection team then walked to the northwest and encountered a linear ditch filled with water. A culvert conveyed water under the road crossing (DSCN4667-DSCN4669). The inspection team then continued north on the road located at AOC-4 (DSCN4670-DSCN4673) until they reached the northeastern extent of the Site, which was set on the waterfront of the Pocomoke Sound.
The inspectors walked the waterfront from east to west and observed a concrete bulkhead situated along the waterfront of Pocomoke Sound. Bricks, concrete, and cinderblocks were observed waterward of the bulkhead (DSCN4675- DSCN4678, DSCN4681- DSCN4684). Campsites, complete with septic hookups were located to the south of the bulkhead (DSCN4680). A wooden pier was observed extending northward into the sound (DSCN4679, DSCN4682, DSCN4684, and DSCN4685). Continuing westward, the inspection team encountered an inlet (DSCN4686 and DSCN4687). To the south of the inlet, a large, inundated area was encountered. On the western bank of the open water area was sparsely vegetated sand, which appeared to have been recently placed (DSCN4688) and included a picnic area, extending to the western boundary and waterfront (DSCN4690- DSCN4694). The inspection team and attendees then traveled back to the Welcome Center conference room, where the Closing Conference was then conducted.
IV. Records Review
A review of Site/facility records was not a component of the inspection; therefore, EPA is not expecting to access business records, including confidential business information ("CBI"). If the Site/facility owner wants to make a CBI claim on information or photographs collected by the inspector during the inspection, he can submit a claim to EPA. After the Site/facility notifies

EPA of the CBI, EPA representatives will mark the CBI as such, and it will be handled as CBI according to EPA's procedures. V. Closing Conference
A. Overview
The Closing Conference was conducted at the conclusion of the walkthrough at approximately 11:15 am. The EPA relayed the findings as discussed in Section B below to Mr. Iocona and Ms. Scott and stated that an inspection report would be completed and disseminated within 60 days.
B. Observations Relayed to Site Representative
The Closing Conference began with a general discussion about the authority of the CWA to regulate the discharge of dredged or fill material into waters of the United States. The inspectors reiterated the purpose of the inspection to collect data and photographs to observe the status of the Site's compliance with Section 404 of the CWA.
The inspectors then summarized the observations and stated that a compliance determination had not been made and would not be included as a component of the inspection or report. The inspectors discussed the presence of wetlands onsite and several AOC that were identified and are illustrated in Attachment 2:
AOC-1, rectangular area to the southeast of the Welcome Center where Mr. Iocona stated that approximately 40 loads of fill were recently placed;
AOC-2, oblong area where fill had been placed on the western portion of the property; AOC-3, area on the central-eastern portion of the property where Mr. Iocona stated that
sand was placed following a recent flooding event to allow trucks to access this portion of the Site. Piles of woody debris and fill were also documented; AOC-4, road constructed above-grade with sand. Two fill piles were observed at the southern and northern terminuses. Ms. Scott stated that the fill pile located on the southern extent was comprised of excavated spoils from the recently constructed septic system; and Waterfront area, it appeared that there was new construction associated with the waterfront campsites located on the northeastern portion of the property. To the west, sparsely vegetated sand was observed on the northwestern portion of the Site.
Mr. Iocona asked if the timeline of activities would be taken into consideration, as Blue Water recently purchased the property in November 2021, and had no prior knowledge of earthmoving activity in some of the areas that had been outlined. The inspectors responded in the affirmative that the timeline of activities would be evaluated, and that the previous owner was recently engaged by the EPA.
The inspectors then discussed CWA permitting and cautioned against the construction of any structures in AOC-1 for the purposes of storage without obtaining a permit from the USACE. Mr. Iocona asked about how CWA jurisdiction could be determined, and the inspectors replied that a Jurisdictional Determination could be acquired from the USACE. Mr. Iocona then stated that he would consider contacting an environmental consultant. David Knepper clarified that in a

situation where there is a potential enforcement action it would need to be addressed before the USACE could issue a Jurisdictional Determination or permit. The inspectors reiterated that an inspection report would be completed and disseminated within 60 days. The Closing Conference concluded, and the EPA left the Site at 11:30 am. C.
