EPA Region 10 Lead Inspector presented credentials to and informed Jeff Van Splunder this was an EPA Region 10 inspection to determine compliance with Resource Conservation and Recovery Act (RCRA). This was a Resource Conservation and Recovery Act (RCRA) inspection. The facility was inspected to ensure compliance with standards for hazardous waste generators and universal waste management (40 C.F.R. Part 262 through 273). The inspection was conducted as part of a Core Program requirement for FY 2024. I presented my inspector credentials to and informed Mr. Van Splunder, Assistant Store Manager, this was an EPA Region 10 inspection to determine compliance with the Resource Conservation and Recovery Act (RCRA). During the opening conference, I explained that the focus of the RCRA inspection was to identify types of wastes generated, points of waste generation, methods of waste management, and review relevant documents. Only those areas in which I observed potential compliance concerns or noted other pertinent issues are discussed in Section III of this inspection report. Mr. Van Splunder initially told me that the facility's waste lamps were managed as hazardous waste, but as I observed later during the inspection and verified through disposal paperwork, the facility was managing their waste lamps as universal waste. They store hazardous waste in two locations: the receiving area and the exterior hazmat cage. We were accompanied during the inspection by Mr. Van Splunder. I looked at the facility's processes, hazardous waste management practices, generation points, and accumulation areas. I looked for wastes that facility representatives had not yet identified or designated as hazardous. I also observed the facility's universal waste. While in the receiving area, we saw an area where the facility was accumulating various sizes of waste fluorescent lamps. During the inspection, we observed the following: A container that held four-foot waste fluorescent lamps was not closed and was not labeled or clearly marked with either of the following phrases: "Universal Waste-Lamp(s)," "Waste Lamp(s)," or "Used Lamp(s)." A container that held a variety of waste fluorescent lamps in various styles and sizes, including four, 1.5foot waste lamps (three loose and one still in the fixture) and two round/circular waste lamps, was not closed and was not labeled or clearly marked with either of the following phrases: "Universal WasteLamp(s)," "Waste Lamp(s)," or "Used Lamp(s)." One, 32-gallon, open-top, poly container that held incidental broken lamps was not labeled or clearly marked with either of the following phrases: "Universal Waste-Lamp(s)," "Waste Lamp(s)," or "Used Lamp(s)." Mr. Holt rotated the drum to demonstrate the lack of labeling. Incidental broken lamps may be managed as universal waste. One, 32-gallon container that held waste lithium-ion batteries was mislabeled as "hazardous waste." Mr. Holt said they manage batteries as Universal Waste. Mr. Holt told us he had run out of the correct universal waste labels and said he could get more from another local Lowe's location. Mr. Holt removed the hazardous waste label at the time of the inspection. A plywood storage bin that held lead-acid automotive batteries was labeled with both a universal waste label and a hazardous waste label. Mr. Holt said the automotive batteries were recycled through a local vendor. Mr. Holt removed the universal waste label and the hazardous waste label from the plywood storage bin at time of inspection. We requested the name of the recycling facility & paperwork regarding the transportation of batteries for recycling. Mr. Holt told us he did not readily have that information on hand but would provide it later. Although weekly inspections of universal waste are not required, during my inspection of the facility's weekly hazardous waste inspection logs following the inspection, I observed that universal waste was something that the facility included in their inspection checklist. Their checklist specifically indicates that inspection personnel are looking to see if waste four-foot lamps, waste eight-foot lamps, and waste CFL fluorescent bulb disposal boxes are properly labeled as Universal Waste Bulbs with the accumulation start date, lids closed, and full boxes sealed? Mr. Van Splunder told us that the Store Manager was not onsite, and he did not have access to these documents. Mr. Van Splunder told me they would have to send the documents to me following the inspection. I returned to the facility on the afternoon of Monday 03/11/24 to see if I could get with the store manager and inspect the documents. At that time, I was told by onsite management that I would need to reach out to Rick Kosmata, Facility Manager for any documentation. Onsite management provided me with Mr. Kosmata's email at the time of my visit. I returned to my office and decided that I would reach out to the facility's point-of-contact (Robert Gass) listed on the facility's site detail report that I reviewed prior to the inspection. I emailed Mr. Gass, Director of Hazardous Waste & Environmental Compliance on 03/21/24 and requested the hazardous waste manifests and LDRs. On 4/2/24, I received an email from Mr. Lionel Dumas, Environmental Operations Compliance Specialist, which included copies of the inspection logs. During my inspection of the weekly hazardous waste inspections, I saw that the facility failed to conduct nine weekly inspections. On 4/2/24, I received an email from Mr. Lionel Dumas, Environmental Operations Compliance Specialist, which included a copy of the one-time LDR for the lead-acid batteries indicating that they were being reclaimed at a lead smelter facility. I thanked everyone for their time and cooperation during the inspection and began a review of the areas of concern (listed in Section III - Areas of Concern) that I observed during my inspection of the facility. I then explained the follow-up process that would take place once I finished the report. I explained they would receive a copy of the report as would a case officer. I told them the case officer would review the report to determine if any of my areas of concern documented violations.
