The Administrator of EPA has delegated the authority to issue this Order to the Regional Administrator of EPA Region 6, who has further delegated this authority to the Director of the Enforcement and Compliance Assurance Division. FINDINGS 7. Respondent applied for and was issued NPDES Permit No. NM0028011 (permit) under Section 402 of the Act, 33 U.S.C. 1342, which became effective on June 1, 2021. At all relevant times, Respondent was authorized to discharge pollutants from the facility to waters of the United States only in compliance with the specific terms and conditions of the permit. 8. Part I.A. of the permit places certain limitations on the quality and quantity of effluent discharged by Respondent. The relevant discharge limitations are specified in Attachment A, which is incorporated herein by reference. 1. Village of Jemez Springs (Respondent) is a "person," as that term is defined at Section 502(5) of the Act, 33 U.S.C. 1362(5), and 40 C.F.R. 122.2. 2. At all times relevant to this Order (all relevant times), the Respondent owned a wastewater treatment plant (WWTP), located at 14609 Highway 4, Sandoval County, NM 87025, New Mexico (facility), and was, therefore, an "owner or operator" within the meaning of 40 C.F.R. 122.2. 3. At all relevant times, the facility acted as a "point source" of a "discharge" of "pollutants" with its wastewater to the receiving water of Jemez River, which is considered "waters of the United States" within the meaning of Section 502 of the Act, 33 U.S.C. 1362, and 40 C.F.R. 122.2. 4. Because Respondent owned or operated a facility that is a point source of discharges of pollutants to waters of the U.S., Respondent and the facility were subject to the Act and the National Pollutant Discharge Elimination System (NPDES) program. 5. Under Section 301 of the Act, 33 U.S.C. 1311, it is unlawful for any person to discharge any pollutant from a point source to waters of the United States, except with the authorization of, and in compliance with, an NPDES permit issued pursuant to Section 402 of the Act, 33 U.S.C. 1342. 6. Section 402(a) of the Act, 33 U.S.C. 1342(a), provides that the Administrator of EPA may issue permits under the NPDES program for the discharge of pollutants from point sources to waters of the United States. Any such discharge is subject to the specific terms and conditions prescribed in the applicable permit. 9. The permit also includes "Monitoring and Reporting Requirements" that require Respondent to sample and test its effluent and monitor compliance with permit conditions according to specific procedures, in order to determine the facility's compliance or noncompliance with the permit and applicable regulations. 10. The permit requires Respondent to file certified Discharge Monitoring Reports (DMRs) of the results of monitoring. DMRs filed by Respondent have shown discharges of multiple pollutants that exceeded the effluent limitations in previous years. 11. On August 11, 2022, EPA issued Administrative Order (AO) Docket Number CWA-06-2022-1812, which cited the effluent limit violations that occurred from 1/1/2021 through 6/30/2022. The AO required Respondent to eliminate cited violations or submit a plan to eliminate violations. Respondent submitted a basic plan of action to begin bringing the facility into compliance. 12. On January 30, 2023, Respondent agreed to a plan that was incorporated into Administrative Order, Docket Number CWA-06-2023-1728. All tasks were required to be completed by December 2024. 13. Respondent received multiple extensions to some dates within the AO but ultimately completed all tasks by December 2024. The AO has been closed out. 14. While respondent has moved forward with permit compliance, some violations have not been fully addressed for proper operation and maintenance or long-term sustainable compliance. CWA-06-2025-1732 Page | 2 15. DMRs filed by Respondent continue to show discharges of pollutants that exceed the effluent limitations. DMRs filed by Respondent showed discharges of multiple pollutants that exceed the effluent limitations for dates 7/1/2022 through 12/31/2024. See Attachment B, which is incorporated herein by reference. 16. Sanitary sewer blockages, back-ups, overflows, and excess inflow/infiltration - all due to improper maintenance of the sanitary sewer collection system - have resulted in raw wastewater discharges to the Jemez River as well as backups into private property. See Attachment C, which is incorporated herein by reference. 17. Each violation of the conditions of this permit or regulations described above is a violation of Section 301 of the Act, 33 U.S.C. 1311. SECTION 309(a)(3) COMPLIANCE ORDER 18. Based on the foregoing Findings and pursuant to the authority of Section 309(a)(3) of the Act, EPA hereby orders the Respondent to take the following actions: A. Immediately take all measures as necessary to comply with permit conditions. B. Respondent shall accomplish the following tasks and comply with the following schedule of activities: TASK DUE DATE 1. Complete cleaning and inspecting the sanitary sewer collection system July 31, to find all areas in need of repair or 2025 rehabilitation. 2. Install new UV Modules September 30, 2025 Submit copy of the comprehensive plans for the rehabilitation and/or 3. upgrades, for both the sanitary September sewer collection system and the 30, 2025 WWTP indicating 30% of the engineering design is complete. Submit copy of the comprehensive 4. plan for the rehabilitation and/or December upgrades, for both the sanitary 1, 2025 sewer collection system and the WWTP indicating 60% of the engineering design is complete. Submit copy of the comprehensive plan for the rehabilitation and/or 5. upgrades, for both the sanitary sewer collection system and the WWTP indicating 90% of the engineering design is complete. Submit the final engineering design 6. plans for both the sanitary sewer collection system and the WWTP. 7. Begin point repairs in the collection system where a comprehensive rehabilitation is not necessary. 8. Begin comprehensive rehabilitation and/or upgrades, of the WWTP and sanitary sewer collection system. 9. Submit copy of Engineer's Contract Status Report prepared for the NMED Construction Programs Bureau by contracted engineer firm within 5 days of receiving. Complete the comprehensive 10. rehabilitation of the sanitary sewer collect system and WWTP Permanently plug/cap the pipe 11. outlets connected to the drying beds or reroute the drainage back to the WWTP. Within thirty (30) days of completing the tasks in "B" above, Respondent shall submit a Project Completion Report with the following information: 1) A description of the task implemented, any problems encountered, and the solutions thereto, 2) Line-item overall capital improvement costs of the project tasks (including but not limited to cost of treatment unit design, repairs and/or improvements, and sewer segment assessments, repairs and/or upgrades). 3) Photographs of project activities, if applicable, 4) Final construction reports, if applicable. D. In the Project Completion Reports, Respondent shall sign and certify under penalty of law, that the information contained in such report is true, accurate, and not misleading by signing the following statement: CWA-06-2025-1732 Page | 3 I certify under penalty of law that I have examined and am familiar with the information submitted in this document and all its attachments, and that based on my inquiry of those individuals immediately responsible for obtaining information, I believe that the information is true, accurate, and complete. If Respondent would like to arrange a meeting with EPA to discuss the allegations in Section 309 (a)(3) Compliance Order, Respondent should contact EPA within thirty (30) days of the effective date of this Order. Sampling for the whole effluent toxicity test shall occur between the first period between November 1 and April 30, after the permit effective date. 7. Total Nitrogen is defined as the sum of Nitrate +Nitrite (N + N), and Total Kjeldahl Nitrogen (TKN). Total Nitrogen is defined as TKN + Nitrites and Nitrates, as found in the TMDL for the Jemez River approved by EPA September 15, 2009. 8. Compliance schedule to monitor and report total recoverable aluminum data for the first three years from the effective date of this permit. Please refer to part 1.B. The pollutant shall be tested using EPA approved method as found in CFR 136 table IB, for the determination of total recoverable metals, and as found in 20.6.4.900.2 The criteria is based on analysis of total recoverable aluminum in a sample that is filtered to minimize mineral phases as specified by the New Mexico Environment Department (NMED). On 12 April 2023, in a 24-hour period, the effluent meter reading noted 330,084 gallons flowed through JSWWTP. Whether an evacuation has occurred No evacuation occurred. corrective actions taken A local drone pilot was contacted to fly along the Jemez River to collect video imagery of the sewer line path from the Forest Service office at mile marker 18.5 down to the Jemez Springs Wastewater Treatment Plant at mile marker 14. Imagery was requested to possibly identify any infiltration locations. After reviewing imagery, three locations were selected for closer inspection and will be physically inspected on 13 April 2023. Jemez Pueblo and the Santa Fe National Forest were both contacted the morning of 12 April 2023 to inform them of the situation. Effluent samples were collected at 1231 for BOD5, TSS, E-coli, Phosphorous, Nitrogen, Boron, Arsenic, and Aluminum. Raw influent samples for BOD5 and TSS were collected at 1237. Both sets of samples were delivered to Hall Laboratories by Mountain Pacific personnel. The following companies were contacted to mitigate overflow into the river: Atlas Pumping, AAA Pumping, American Pumping, and West 44 Pumping. Atlas Pumping hauled 6,000 gallons on 12 April and is scheduled to haul 12,000 gallons on 13 April. West 44 10,000 gallons on 12 April and is scheduled to haul 6,000 on 13 April, American Pumping hauled 20,500 gallons and is on standby for 13 April, AAA Pumping is scheduled to haul 12,000 gallons on 13 April. A total of 42,500 gallons was pumped from JSWWTP and hauled to dump sites in Los Lunas, New Mexico. The effort to mitigate overflow into the river could not keep up with the influent volume. To manage/mitigate overflow based on 330,000 gallons of influent, would require 24-hour coverage with at least 30 loads, at 6,000 gallons per load, staggered to maintain full coverage. A public notice published on a local Social Media site requesting Village residences to reduce water usage was posted on 12 April 2023. The river is under flood hazard conditions until 17 April 2023.
