III. Permit Information
On July 21, 2006, the U.S. Environmental Protection Agency (EPA) issued the National Pollutant Discharge Elimination System (NPDES) permit for Federal Aquaculture Facilities and Aquaculture Facilities within the boundaries of the State of Washington ("Permit"), permit #WAG130000. The permit became effective on September 1, 2006, and expired on June 30, 2011. The discharge permit was previously held by Jessie's Ilwaco Fish Company and was transferred to Safe Coast Seafoods on January 27, 2021. Subsequently, the permit was administratively continued and was modified on January 27, 2021.
IV. Enforcement Background
The facility had received a civil penalty on January 31, 2022, for $69,348. This was issued by Washington's Department of Ecology for violating provisions of Chapter 90.48 Revised Code of Washington (RCW), the National Pollutant Discharge Elimination System Permit Program, and the National Pollutant Discharge Elimination System Permit WA0041971. These violations were due to effluent limitation exceedances of "average monthly chlorine", "daily max chlorine", "max pH", "monthly geometric mean E. coli", and "daily max E. coli". The Notice of Penalty is attached to this Report as Attachment C. Safe Coast Seafoods has so far

made two payments of $17,337 and makes monthly payments of $9,818 until the penalty is paid off. These payments are made by their corporate office in Hayward, CA. Permit Special Condition S1.A. sets specific effluent limits for wastewater discharge and was put into place on January 31, 2022.
The facility has also received 11 Letters of Violation, two Notices of Violation, and over 45 DMR Non-Receipt Violations since the transfer of ownership was made.
V. Inspection Chronology
This was an announced inspection. On July 28th, 2022, I called Safe Coast Seafoods in Ilwaco, Washington, and left a message. On August 3, 2022, I spoke with Mr. Jeff McEntarffer and scheduled the inspection for August 16, 2022.
On August 16, 2022, I arrived at the facility at 10:30 a.m. and I presented my credentials to Mr. McEntarffer and Mr. Rick Fuller, an environmental consultant who works for Trendline Environmental Chemistry. I was accompanied by Mr. McEntarffer and Mr. Fuller throughout the entire inspection and was not denied access to any area of the facility. Mr. McEntarffer answered all my questions.
I began the inspection with a brief opening conference with Mr. McEntarffer and Mr. Fuller and I explained the scope of the inspection. We first sat down in the office on site, and I conducted a file review. Mr. McEntarffer then led us on a tour of the facility and explained the various processes of their operation. We ended with a brief closing conference outside to discuss observations and next steps.
VI. Opening Conference
Safe Coast Seafoods is located in Ilwaco, Washington and is a seafood processing facility that sells seafood to markets, wholesalers, and distributors. The facility's seafood wastewater is discharged into Baker Bay, Colombia River. The discharge permit was previously held by Jessie's Ilwaco Fish Company and was transferred to Safe Coast Seafoodson January 27, 2021. The facility was shut down for about one year while the transfer to new ownership was being made.
The facility processes fin fish, crab (seasonally), oysters, and clams. Offloaded whole fish are then filleted, scaled, cleaned, and gutted. Crabs are either cooked, sectioned, or sent off to a livewell tank. Oysters are currently just put into bags although Safe Coast Seafoods recently submitted a request to the Washington State Department of Ecology to be able to shuck oysters. They are still waiting on approval. Clams and oysters were added to the permit on May 16, 2022. Safe Coast Seafoods utilizes a dissolved air flotation (DAF) system to assist in processing seafood wastewater. The process clarifies wastewater by the removal of suspended matter, including oils and solids. Dissolved air is forced into the wastewater under pressure and as the pressure

is normalized to atmospheric pressure in the tank basin, the released air forms very small bubbles which adheres to the suspended matter making it easier to skim off the surface. Originally, the DAF system was made to only treat wastewater coming from surimi. Mr. McEntarffer informed me that they have recently replaced the DAF's pumps and motors and that they are looking for another system to replace the DAF system. Mr. McEntarffer also informed me that their recent exceedances of residual chlorine are ultimately due to the circuit board not correctly communicating with the DAF pumps. The circuit board has since been corrected. The removed solids from the DAF system are brought to the Pacific Gro Farm.
An ISCO GLS composite sampler samples between every 1 - 1.5 hours between the hours of 0600 and 1300. A Sparling flow meter is calibrated annually by the manufacturer, Measure-Tech Inc. The flow meter was last calibrated on January 22, 2022. Their pH meter is calibrated annually. Temperature is measured with a probe in the outflow sump.
VII. Laboratory Inspection
Two labs are currently contracted by the company. The potential of hydrogen (pH) is analyzed in-house. ALS Environmental, out of Kelso, WA, monitors for E. coli, oil, & grease, BOD, and TSS. Edge Analytical monitors for residual chlorine.
VIII. Site Review
Mr. McEntarffer led me on a tour of the facility. An aerial image appears in Attachment A and a photograph log appears in Attachment B.
We first walked by the dock where tuna was being offloaded and put into large boxes for wholesale. We then walked through the various stages of crab, fish, oyster, and clam processing. Safe Coast Seafoods utilizes various tanks and chilling systems to process fish and to freeze crab.
The dissolved air flotation (DAF) system (Photos 2 & 3) treats all the facility's wastewater. This is an older system that was initially manufactured to process wastewater coming from surimi. For the DAF system, I examined the chlorine pump (Photo 4), the 3DT Control Panel (Photo 5), the control system for adding pressurized air (Photo 6), and the flocculation zone for the system (Photo 7). I also examined the composite sampler (Photo 8), the Sparling flow meter (Photo 9), and the effluent sampling point (Photo 10).
The City of Ilwaco's WWTP (Photo 11) and Safe Coast Seafoods share an outfall discharge pipe. Both effluents join in a manhole to the east of the marina. Baker Bay (Photo 12) receives these combined effluents from an outfall approximately 6 feet from the reinforced shoreline and at the high tide level. These effluents flow across tidal mudflats for up to several hundred yards before meeting Baker Bay during lower tides.

1. Effluent Limitations
Section S1.A. of the permit requires that certain effluent limitations be met. "All discharges and activities authorized by this permit shall be consistent with the terms and conditions of this permit. The discharge of any of the following pollutants more frequently than, or at a level in excess of, that identified and authorized by this permit shall constitute a violation of the terms and conditions of this permit."

2. Operation and Maintenance

Section S4.A. of the permit states that "The Permittee shall, at all times, properly operate and maintain all facilities or systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems, which are installed by a Permittee only when the operation is necessary to achieve compliance with the conditions of this permit."
The concern is that the DAF system was initially manufactured to process surimi but Safe Coast Seafoods is currently processing fin fish, crab, shrimp, and oysters. It is also a concern that some of the auxiliary systems to the DAF system have not properly operated in the past. However, Mr. McEntarffer did state that the pumps and motors were replaced and that the circuit board's communication issues were rectified.
3. Solid Waste Control Plan
Section S6.C. of the permit requires that "The Permittee shall submit a solid waste control plan to the Department no later than January 1, 2007. This plan shall include all solid wastes with the exception of those solid wastes regulated by Chapter 173303 WAC (Dangerous Waste Regulations). The plan shall include at a minimum a description, source, generation rate, and disposal methods of these solid wastes. This plan shall not be at variance with any approved local solid waste management plan. Any proposed revision or modification of the solid waste handling plan must be submitted to the Department. The Permittee shall comply with the plan and any modifications thereof. The Permittee shall submit an update of the solid waste control plan with the application for permit renewal on or before January 1, 2010."
The facility was not able to produce a solid waste control plan at the time of the inspection or within 8 weeks after the inspection. A Solid Waste Control Plan was submitted by Jessie's Ilwaco Fish Company in 2007 and 2013 but the 2013 plan was not accepted/approved by Washington's Department of Ecology. The permit requires there to be such a plan in place and for the permittee to comply with that plan and any modifications thereof.
XI. Closing Conference
I held a closing conference with Mr. McEntarffer following the inspection outside. I stated that no areas of concern were identified over the course of the inspection and gave a brief overview of the post-inspection process. I thanked him for his time and assistance.
