Dear
,
Thank you for contacting the European Chemicals Agency (ECHA) and showing interest in the PFAS restriction proposal.
Globally, PFOS, PFOA and PFHxS have been included in the Stockholm Convention and under the EU's Persistent Organic Pollutants (POPs) Regulation: PFOS - https://echa.europa.eu/list-of-substances-subject-to-pops-regulation//dislist/details/0b0236e184a3135d PFOA - https://echa.europa.eu/list-of-substances-subject-to-pops-regulation//dislist/details/0b0236e1849a8bdf PFHxS: Delegated regulation - C(2023)3387 and Annex - C(2023)3387 available from https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/13425-Persistentorganic-pollutants-perfluorohexane-sulfonic-acid-PFHxS-_en
Currently, a number of PFAS are on the REACH Candidate List of substances of very high concern (SVHC): Pentadecafluorooctanoic acid (PFOA) - https://echa.europa.eu/candidate-list-table//dislist/details/0b0236e1807db2ba PFHxS - https://echa.europa.eu/candidate-list-table/-/dislist/details/0b0236e18184a0e1 2,3,3,3-tetrafluoro-2-(heptafluoropropoxy)propionic acid, its salts and its acyl halides (HFPO-DA) - https://echa.europa.eu/candidate-list-table//dislist/details/0b0236e1833efc3e perfluoroheptanoic acid (PFHpA) and its salts - https://echa.europa.eu/candidate-listtable/-/dislist/details/0b0236e187e718eb
Some PFAS are also restricted under REACH: C9-C14 linear and/or branched perfluorocarboxylic acids (C9-C14 PFCAs) https://echa.europa.eu/substances-restricted-under-reach//dislist/details/0b0236e181e91f73 Additionally, there are restrictions proposals: Restricting the use of per- and polyfluoroalkyl substances (PFASs) in fire-fighting foams - https://echa.europa.eu/registry-of-restriction-intentions//dislist/details/0b0236e1856e8ce6 Broad restriction proposal of Per- and polyfluoroalkyl substances (PFAS) https://echa.europa.eu/registry-of-restriction-intentions/-/dislist/details/0b0236e18663449b
To stay up to date with the latest developments, you can consult ECHA's dedicated page on PFAS at https://echa.europa.eu/hot-topics/perfluoroalkyl-chemicals-pfas
For a general introduction to the restriction process, please check the infographic on ECHA's website at https://echa.europa.eu/restriction-process.
If the restriction proposals are successfully adopted into law, they will be included as entries in the Annex XVII to REACH. Once a restriction is adopted, it is industry's responsibility to comply with restriction conditions. Compliance with the restriction is enforced by the Member States and demonstrating compliance may require testing.
