I traveled to Augusta on that date and learned from the Employer that they would not consent to the settlement unless agreed to make repayment on the overpayment made to him by Sherwin-Williams. I telephoned you, and we agreed that we would now proceed with the settlement without the Employer's consent. Richard Hewes appeared at the Augusta Board along with Ken Lexier, attorney. I explained the situation to both attorneys. Although we hoped to negotiate with an agreement where some of the lump sum settlement payment would go to Sherwin-Williams's reimbursement, never received notice of the hearing. Therefore, it will be rescheduled. Hopefully, Attorney Hewes will negotiate an agreement with the Employee in the meantime which could be wound up at a lump sum settlement conference.
