Inspections were conducted from around 8:00 AM to 3:00 PM on all three days. On February 7, inspectors were joined by CPC Officer Jennifer McPhail. EPA Inspectors were looking for parts designed to enable the removal of emission controls installed on EPA certified motor vehicles. These included products such as Exhaust Aftertreatment Delete Hardware, EGR Delete Hardware, and Tuners which allow equipment to be removed. At the request of EPA, CBP placed holds on packages shipped from Tuner Depot, d.b.a. TD Fulfillment and provided inspectors access to the packages. Inspectors examined and photographed the external packaging for labels and part numbers. Packages without part numbers or unverified part numbers were opened and the products inside the packages was photographed. Literature inside packages were also photographed. In these packages inspectors found stainless steel pipes that were advertised as delete pipe, offroad use only, and DPF delete pipe. Inspectors also found EGR delete kits and Tuners which were advertised as products that allow the customer to remove emissions control software from the vehicle. Inspectors documented the shipment ID, consignee, observed part number, observed SKU, and observed quantity. If available, part type and vehicle fitment was also documented. Once the inspection of the package was complete, opened packages were retaped. CBP requested shipment invoices from UPS for all TD Fulfillment packages inspected. CBP then digitally provided these documents to EPA per rules set out in the joint-agency Memorandum of understanding. From the shipment invoiced CBP provided to EPA inspectors were able to confirm that each of these parts was sold by TD Fulfillment to US buyers and that TD Fulfillment offered to sell each of these parts for shipment to the United States, and that the parts are designed and sold with the intent to enable the removal of emissions controls, violating CAA section 203. Facility Name: Tuner Depot d.b.a TD Fulfillment Facility Location: 650 Administration Drive, Louisville, KY 40220 Date of Inspection: February 6, 2024 Photos and/or Videos: were taken during the inspection and are listed in Appendix A.
