CLEVELAND, OHIO 44101 S-W 003461 FOREWORD This Label Manual is prepared for formulators, sales division personnel, PC&C salesmen and any other Institutional personnel to whom it will be of use. The information given and caution copy shown is in accord with the latest received and all efforts will be made to keep it up to date as new products are developed or new Regulations are issued by Food 6c Drug or other governmental agencies. In the event any of these cautions are supplied to and used by customers, the identification system set forth in the Manual should not be used by them as the system used is peculiar to our own set-up. The cautions in the Manual are an expansion of those established by The National Paint, Varnish 6c Lacquer Association and are formulated to simplify, particularly, the assignment of the proper caution clause by the formulators or by any other persons charged with that duty. Where the NPV&L Association Manual covers three or four situations with one proposed caution, we are setting up every possible situation with a separate and distinct caution so that when the caution identifications are placed on the formulae cards, no change is required unless a reformulation takes place that requires a different caution. The goods produced and subject to the law have been divided into eight classes which roughly are as follows: Qass 1 -- Pigmented paint products which have been divided into six divisions with the flash point and viscosity being the controlling factors. Class 2 -- Pigmented paint products paralleling the Class 1 groupings with a caution showing that the product contains lead or any other of the heavy metals in excess of certain minimum amounts. Class 3 -- Latex paints. Class 4 -- Paint and varnish removers. Class 3--Aerosols. Qass 6--Products that are clear or have a heavy pigment that settles to the bottom leaving a light natant fluid on top. Class 7--Cement paints. Class 8--Products that are specialties and each one would generally have a separate cau tion setting forth the hazards involved. ' S-W 003462 To further amplify the identification symbols for each hazard, we have set them up as fol lows and this identification holds true throughout Classes 1 and 2: a -- flash point 81 'F. - 150F. -- more viscous than 150 S.S.U. b -- flash point 210F. - 80" F. -r- more viscous than 150 S.S.U. c -- flash point 20*F. or less -- more viscous than 150 S.S.U. h --flash point 813F.- 1503F.-- less viscous than 150 S.S.U. k -- flash point 213 F. - 80F. -- less viscous than 150 S.S.U. l --flash point 20aF. or less--less viscous than 150 S.S.U. We are required to warn when the product contains more than 10% aromatics and the identification symbols are as follows: r for benzene; t for toluene; x for xylene; w for a mixture of toluene and xylene, and z for aromatics other than the above. The aromatics require the spe cial caution -- Vapor Harmful. The Food & Drug Administration has decided that products more viscous than 150 S.S.U.'s could not be aspirated into the lungs if vomiting is induced, so consequently, it is not necessary to carry the caution -- "If swallowed, do not induce vomiting," which is required on the products less viscous than 150 S.S.U.'s. This ruling was arrived at through the efforts of the NPV&L Association securing Dr. H. W. Gerarde of Esso Research Laboratory to testify as an expert and accounts for viscosity being measured in S.S.U.'s rather than a paint viscosity standard. The dividing line of the 150 S.S.U.'s is at about the viscosity of the A-l Gardner Tube. When establishing the caution on the Label Analysis Sheet A 127 B, it is advisable to type below the caution designation the harmful ingredients to be warned against so that the same can be inserted in the caution clause if required and the caution in itself is not fully explanatory. Class 2 as indicated above covers the products containing lead compounds of which the lead content (calculated as Pb) is in excess of 1% of the total weight of the contained solids (including pigments, film solids and driers. Mercury not in excess of 0.2% mercury as metal on the total of the paint is acceptable under the Federal Hazardous Substances Labeling Act, while the Z66.1 Committee of The American Standards Association says that coatings suitable for children s toys, furniture or interiors where children are kept shall not contain compounds of antimony, arsenic,.cadmium, mercury or selenium of which the metal content individually or in total (calculated as Sb, As, Cd, Hg or Se respectively) is in excess of .06% by weight of the contained solids (including pigment, film solids and driers) or shall not contain barium com pounds of which the water soluble barium (calculated as Ba) is in excess of 1% of the total barium in such coatings. S-W 003463 rta 3 covers the latex products and provides for those coatings that only contain latex and those which include lead, mercury or other heavy metals in the limits set forth in the Class 2 requirements. Class 4 is reserved for the Paint and Varnish Removers and covers both the Flammable and Non-Flammable products. These are limited in number and are practically tailor made for each product involved. The assignments are arbitrary and do not have any special significance except for identification. Note that the cautions for those products containing benzol carry the aromatic hydrocarbon caution although the caution identification does not do so. Class 5 covers the Aerosols and conforms to the latest N.Y.C Fire Department regulations. Type size is important and a copy of the regulations should be secured so that full compliance may be had. The warning must be printed in red on a white background for Flammable and Extremely Flammable products. Class 6 is reserved for those products which are thin and non-pigmented or have a heavy pigment that readily settles and leaves a clear natant liquid on the top. Because of the water-like characteristic of many products in this class, these cautions warn against transfer to bottles or other unlabeled containers. Natural products for this caution are: Thinners; Reducers; thin colorless varnishes; aluminum paints, etc. Class 7 covers the cement or lime containing products or products requiring a caution warning against getting into eyes or on skin. Class 8 is a catchall classification and will cover those specialty products which require cautions against hazards not ordinarily found in the products made by our industry. The assign ment in this group is arbitrary and the identification symbol has no significance. It will be noted that some of the cautions are split between the Face Panel and the Back Panel (or Side Panel) and where this occurs, the portion designated "Face Panel" must be on the face or principal display panel and the balance designated "Back Panel" can be there or on the Side Panel or if desired can be included with the Face Panel's required information on the face with the line "Read carefully cautions elsewhere on the label" being omitted. The type sizes given are for gallons and larger and the Regulations in Sea. 191.01 "Place ment, Conspicuousness, Contrast" state as follows: a. The signal word, the statement of principal hazard or hazards and instructions to read carefully any cautions chat may be placed elsewhere on the label shall appear together on the main panel of the label. This must be placed together and distinctively apart from other wording or designs. It can be set out within the borders of a square or a reaangle, with or without a borderline and by use of suitable contrasts with the back ground achieved by distinaive typography or color or by both when needed. b. If produa is highly toxic, a skull and crossbones must be used with the word "poison" -- this does not have to be on the main panel. S-W 003464 c. The signal word and statement of hazard must be in capital letters. These shall be of a size bearing a reasonable relationship to the other type on the main panel but not less than 18 point type; the statement of hazard shall not be less than 12 point type unless the space is too small to accommodate such type size but in no event smaller than <S point type. d. Items other than those set forth above shall be no less than 10 point type and must be placed together elsewhere on the label, with adequate contrast achieved by typography, color or layout and in no event less than 6 point types unless an exemption has been applied for and granted by Food 6c Drug. On collapsible, metal tubes all information required by the laws and regulations shall appear as close to the dispensing end of the container as possible. One good rule to follow is to look at your labels and satisfy yourself that the cautions are prominently located, easily read and plainly set forth the hazards involved and what to do about them. As now established, you may use 18 point type for gallons and larger and down to 6 point type for the smallest sizes unless you get an exemption.
