Architects, code officials, public agencies, and insurance underwriters have all become conscious of the impor tance of using products that provide assured protection to structures. PLAINTIFF'S EXHIBIT 33g~ (2) There have been a large number of new designs for floor and structural systems. Many of these new designs require fireproof ing performance more demanding than in the past. (3) With thenew A STM E-119 criteria, new standards for fireproof ing have been established that provide for increased fire protection. (4) With the recent concern about asbestos as a potential health hazard, legislation in certain areas has prohibited the use of asbestos as an ingredient in many products, including fireproofing materials. M ONOKOTE is a gypsum-vermicuiite mix, applied as a.plaster mortar. Therefore, airborne particles of any kind are of no real concern, unlike, for example, the emissions generated by the spraying of dry-type fibrous fireproofing materials. However, when certain cities became concerned with airborne asbestos particles, they, unfor tunately did not differentiate between M ONOKOTE and other fireproofing products. The re sult was a total ban on all materials which contained asbestos, regardless of the air contamina tion problem that any particular product might pose. Thus. M ONOKOTE 3 was banned in cer tain cities, along with a host of other material's. This necessitated the development of an asbestos-free material, which we marketed as M ON OKOTE 4. Our research work continued, however. We recognized that simply developing a material which contained no asbestos was not enough. With the industry's increasing demand for improved fire protection and with the design of new and more critical construction systems, a material exceeding even the outstanding performance of M ONOKOTE 3 and M ONOKOTE 4 was needed.
