This is Study 22. Refer to the enclosed "Dis charge Monitoring Report - Quality Assurance (DMR-QA) Study 22 NPDES Permittee Instruc tions (Chemistry Portion)" for further details on what you must do during DMR-QA. We will announce in a separate letter the instructions for the Whole Effluent Toxicity (WET) portion of this study. DMR-QA applies to all major and selected minor permittees under the National Pollutant Discharge Elimination System (NPDES). The purpose of DMR-QA is to evaluate the analytical and reporting ability ofthe laboratories that routinely perform the inorganic chemistry and WET self monitoring analyses required in the NPDES permits. You, as a permittee, are periodically required to report these analytical results in a Discharge Monitoring Report (DMR). Your participation in DMR-QA, including proper analyses, reporting and record retention, is mandatory based on the authority of Section 308 (a) of the Clean Water Act. The Agency's legal opinions, dated August 11,1977 and January 9,1989, reaffirm this authority. Your participation in DMR-QA helps the regulatory agencies monitor the quality of the data used to ensure the safety of the nation's water. Chemistry Study 22 is the third DMR-QA study which requires the chemistry samples and subsequent permittee performance evaluation reports to be obtained from commercial providers who have been accredited by the National Institute of Standards and Technology (NIST), National Voluntary Labora tory Accreditation Program (NVLAP). A list ofNVLAP-accredited providers is in the enclosure, or may be found at: http://ts.nist.gov/ts/htdocs/210/214/scopes/calchem.htm. Some of the analytes listed on your permit may not be included in the DMR-QA Study. You are required to report results for the analytes listed in your permit only if they are included in the DMR-QA Study 22 samples. Study analytes not listed in your permit may be reported as voluntary analytes. This will be the first DMR-QA study to use commercial providers accredited by NVLAP. NIST has stated its goal to accredit providers by the beginning of July. However, none has been accredited as ofthe date of this letter. When U.S. EPA is notified that providers have been accredited for WET testing, we will send you a letter announcing the WET portion of Study 22. The letter will include the requirements for the WET study, including start and completion dates. The WET testing will include the same test methods and test organisms that have been required in previous DMR-QA studies. You will be required to report results for the test organisms listed in your permit only if they are included in DMR-QA Study 22. In future DMR-QA studies, we plan to announce the chemistry and WET portions at the same time. You are required to have your normal laboratories analyze DMR-QA Study 22 samples for each of the DMR analytes required in your permit, provided that appropriate study samples/toxicants are available (see list of DMR-QA analytes given in the chemistry laboratory instructions that follow). If you routinely perform any analyses at your facility such as pH, TRC, etc., these tests are required to be con ducted on-site by the in-house individual responsible for doing the testing. If more than one laboratory performs the analysis on a particular analyte, the laboratory performing the majority of the analyses must analyze the samples for the DMR-QA Study. 3. Inform each in-house or contracted chemistry support laboratory that routinely produces DMR data for your NPDES permit which analyses they must conduct and report to you. Also, send these laboratories a copy of the following enclosed pages from this study package- a) DMR-QA Chemistry Laboratory Instructions (pages 9-11) b) DMR-QA State Coordinators List (pages14-16) If you have more than one chemistry laboratory that must analyze DMR-QA Study 22 samples, you may direct all of the labs to get their chemistry samples from the same source (i.e., PROVIDER = manufacturer of the test substance). Remember that YOU must have the resulting chemistry data evaluated by the PROVIDER that manufac tured the samples you and/or your contract lab analyzed. Because you are respon sible for all DMR-QA data, a common source for all chemistry samples would clearly be advantageous to you. 4. Make certain that your in-house and/or contracted chemistry laboratories understand and complete all requirements. Each laboratory or data reporting entity must use the USEPA assigned Laboratory Code on all reported results. For new labs,' codes can be assigned by Mr. Charles Feldman, USEPA, NERL Rm 525, 26 W Martin Luther King Dr, Cincinnati, OH 45268, (513) 569-7671. 4 ABD00132714 a) Obtain appropriate samples as required by your permit. Requests for test samples must be received by the appropriate PROVIDERS no later than June 5, 2002. Note: You or your contract lab may want to use your DMR-QA study results as one of your Proficiency Testing (PT) rounds for other certification reasons (e.g., state certification). If this is the case, please contact your certification program coordinator (e.g., State Coordinator) to determine if they will accept the results from a standard DMR-QA Study (i.e., start date = June 5; end date = September 20) for your PT round. Some states will not accept the standard DMR-QA results. If you determine this to be the case, you can elect to use an approved WP Study for generating results for DMR-QA Study 22 that also are acceptable for a PT round. WP studies are only valid for DMR-QA Study 22 if the study meets the following requirements: 1) Data (i.e., final results) must not be released prior to June 5, 2002. 2) Study close date is on or before September 20, 2002. 3) Study is offered by a NIST Accredited Provider. If you choose to use a WP study, please be aware that you must obtain the data from your contract laboratories in time to report all data to the PROVIDER by their published WP Study Close Date. [Notify the Provider that WP is being used for DMR-QA]. For example, if the PROVIDER'S WP Study in which you choose to participate requires that data must be reported by September 1, 2002, you must report all data from your in-house and contract laboratories to the PROVIDER by September 1, 2002. Because the study close date is prior to September 20, 2002, the study is valid to meet the requirements for DMR-QA Study 22 (i.e., the study is a DMR-QA Qualified Study). It is not acceptable to extend a PROVIDER'S published study close date to September 20, 2002 simply because this is the DMR-QA deadline. b) Perform the analyses within the deadlines defined by the PROVIDER. Note: All in-house and contract laboratories must complete the analyses by the study deadlines defined by the PROVIDER. You and your inhouse or contract laboratories must determine the date by which analytical data must be provided to you to allow enough time to complete the final report to the PROVIDER. Once complete, the results must be reported to the PROVIDER by the applicable study close date. Consult your PROVIDER for their study start and close dates. c) Obtain the results of the analyses on the DMR-QA Study 22 Data Report Form(s) or WP report form(s) received with each PROVIDER'S sample kit(s). As the Permittee, you are responsible for sending these results along with the required cover pages ("NPDES PERMITTEE DATA REPORT FORM" - see #5 below) to the PROVIDER. 5 ABD00132715 5. Complete the Information on the four enclosed pages entitled "NPDES PERMITTEE DATA REPORT FORM" for DMR-QA Study 22. After you receive raw data results from your chemistry laboratories, make copies of the four report forms and attach a copy to each PROVIDER DATA REPORT FORM (the page(s) containing analytical results) received from each laboratory. This creates a permittee data package that is ready for submission to each PROVIDER from whom samples were purchased. No later than September 20, 2002, you must submit each of these permittee data packages for evaluation to the PROVIDER that produced the samples which were analyzed. a) For chemistry data, each PROVIDER will evaluate the data you and your regulatory authority report and send a performance evaluation (PE) report to you, your state and Regional DMR-QA coordinators, and the USEPA by December 18, 2002. b) As the Permittee, you are responsible for submitting all of the results for the tests required specifically by your permit to your regulatory authority no later than September 20, 2002. If you wish to report results for "voluntary analytes" (i.e., analytes you never report on a DMR for your permit), simply check the "voluntary analyte" box beside such values on the data sheet and these data will be evaluated unofficially. Note, however, that you cannot receive official credit for any data reported as "voluntary" and that you may incur extra charges for the "voluntary" data (i.e., officially such data will be treated as if you never reported it). Include the completed "Analyte Check List, DMR-QA Study 22" (page 12) with the package you are submitting to your regulatory authority. 6. Once all performance evaluation reports have been returned by PROVIDERS, you are responsible for investigating and identifying the cause for any data judged "not acceptable." A report identifying the causes and your system changes to correct them to avoid their reoccurence must be sent to your primary regulatory authority/DMR-QA coordinator on or before February 5, 2003. It is recommended that this report be sent by overnight courier or certified mail to assure delivery and to provide a means of tracking if a problem should occur. To acquire the DMR-QA Study 22 chemistry test samples that you will need to analyze, please contact one of the NIST NVLAP-accredited PROVIDERS listed on page 13. If both your laboratory and the permittee laboratory must analyze DMR-QA Study 22 samples, you may want to coordinate with the permittee so that you both get your samples from the same PROVIDER. Remember that the permittee must have the resulting data evaluated by the PROVIDER that manufactured the samples. Because the permittee must report all results and each PROVIDER produces a unique report, a common source for all samples would clearly be advantageous in reducing the number of data reports that the permittee must manage. If you are using a WP sample to satisfy the DMR-QA requirements remember, each laboratory is required to send to each participating permittee the data that each permittee has requested in time for the permittee to report all results to the PROVIDER by the PROVIDER'S published reporting date or no later than September 20, 2002. The permittee is required to report sample data produced by laboratories that routinely perform specified chemistry analyses for DMR purposes. The chemistry analytes for DMR-QA Study 22 are: aluminum arsenic cadmium chromium cobalt copper iron lead manganese mercury nickel selenium vanadium zinc ammonia nitrate orthophosphate total Kjeldahl nitrogen total phosphorus COD TOC i^5*-day BOD 5-day carbonaceous BOD <^H tojal cyanide l^fion-filterable residue (TSS) oil and grease total phenolics (by the 4AAP method) total residual chlorine The permittee that sent you these instructions will indicate which analyses you are to per form. To acquire the DMR-QA Study 22 chemistry samples, arrange to purchase them from one of the NIST NVLAP-accredited providers listed on page 13 and at http://ts.nist.aov/ts/htdocs/210/214/scopes/calchem.htm or as specified by the permittee. DMR-QA Study 22 sample orders must be placed by June 5, 2002. After completing your analyses, enter your analytical data and laboratory identification on the data reporting form received with your samples, be sure to follow the PROVIDER'S instructions and deadlines received with these samples. Send each participating permittee the data they requested using the PROVIDER'S data reporting form, or a copy of it, allowing sufficient time for the permittee to send the completed form to the PROVIDER by the PROVIDER'S published study close date. If you must participate in a Water Pollution (WP) study for the same analytes in order to qualify for state wastewater laboratory certification, you may be able to report the same analytical results to both a) the requesting permittees, to satisfy your DMR-QA obligations and b) the NIST NVLAP-accredited PROVIDER that supplied the DMR-QA Study 22 chemistry samples for WP evaluation to satisfy your state certification requirements if the study results are published after June 5, 2002.
