The claimant was present with his attorney, Dennis Miller. The Hearing Officer was Steven Loomis. As you know, the issue at the hearing was the allowance of the claim. Mr. Miller had originally requested that the claim file on the 1983 injury be referred to Cincinnati for a hear ing. As a result, only the new claim file was available at the hearing and it contained few materials regarding the 1984 exposure to chemical fumes. The only report contained in the file was a report from Dr. Brooks where he had concluded that claimant had bronchial asthma as a result to his exposure to chemicals over the years. At Mr. Miller's request the claimant described the 1984 incident. He also described the 1983 incident and stated that his chest pains had started after those two exposures. He even stated that he had not experienced any chest pains before those two exposures. In light of Dr. Brooks' conclusion that claimant's exposure to chemicals over the years had caused his bronchial asthma, Mr. Loomis stated that he could not allow a 1984 injury on which there was no medical evidence or diagnosis. Mr. Miller then requested a continuance of the hearing so that the two files would be available at the next hearing.
