Previous Enforcement Actions: None known III. Type and Purpose of Inspection Unannounced evaluation of compliance with the 2017 Construction General Permit IV. Facility Description The site is an over-55 residential development. It includes 9 detached single - family houses along the east side of Hatherly Road, and a much larger area west of Hatherly Road with 142 units in three and four - unit buildings (plus a clubhouse and other amenities). The western portion, 56 acres, covers most of the area between the pre- existing Hatherly Road, Ermine Street, Tilden Street, Tilden Road, and the school to the west. The central part of the site slopes down to the east, flattening out east of Hatherly Road; the southern section slopes mostly down to the south; the northwestern section is fairly flat. The site includes a large stormwater basin / wetland area to the north, with a smaller detention basin downhill to the east. A large stormwater basin / wetland is to the south, with a stream running south to its west. Three detention basins are west of that stream in the center / south area, in the southwest of the site, and in the northwest corner of the site. Two temporary / informal basins are near the houses east of Hatherly. At the time of the inspection, the single houses were mostly complete or well underway; the clubhouse and residential buildings in the center and east of the site were complete or well underway (roofs and walls complete). Many units were sold and occupied. Houses to the southwest (along Benjamin Lane) were in various stages of completion. A large graveled staging area was west of the midpoint of Thelma Way; no houses were complete west of Thelma way or at the north end of Thelma Way. The single - family area and the larger multiple - unit area each have a separate notice of intent (NOI) for 2017 Construction General Permit coverage submitted; the stormwater pollution prevention plan (SWPPP) on site covered both areas. V. Inspection A. Opening Conference Mr. Spejewski drove onto the site and found a construction trailer office in the north center of the site. He entered the trailer and met Brian Spalding. Mr. Spalding identified himself as the project manager, and asked Mr. Spejewski to meet with Ryan Duvall (both were Toll Brothers employees). B. Records Review 2 ED_019088A_00019806-00002 Mr. Spejewski presented his credentials to Mr. Duvall, provided a copy of the Small Business Resources Information Sheet, and explained the purpose of the inspection. Mr. Duvall explained that he currently worked on another Toll Brothers site but had worked on Seaside at Scituate until a couple months ago and so could give a tour. Mr. Duvall provided a copy of the SWPPP and operator inspection reports [see pictures for documentation]. The SWPPP appeared complete and covered both parts of the project - the single - family east of Hatherly and the multi - unit buildings west of Hatherly. Operator inspection reports were present. C. Facility Tour Mr. Spejewski and Mr. Duvall then left on a tour of the site. The large basin / wetland to the north had well - established vegetation on the floor and walls. Mr. Duvall said it infiltrates all inflow; a rip - rap overflow on the east side showed no obvious signs of past flow (such as sediment staining on rocks or eroded channels). Mr. Duvall explained that the hoses leading to this area were for water pumped up from the far side of Hatherly Street, as a temporary measure. To the west of the large wetland basin, slightly down a slope, was a smaller, unvegetated stormwater basin. It appeared in good shape with well - established grass. East of that basin a steeper slope led down to Hatherly Street. The slope had thick weed growth. A ditch led across the slope and down to just north of the main site entrance from Hatherly Street. The ditch was lined with jute netting with silt fence at the top of the ditch on the downhill side. The ditch discharged to a ditch running north along Hatherly Street; the ditch was lined with plastic, again with coarse jute netting (about a two - inch mesh) lining the bottom. Mr. Duvall said the jute was to capture sediment. The ditch discharged to a catchbasin on the west side of Hatherly Street. The east and central areas of the site had completed buildings and well - established grass in nearly all places; a couple buildings were being completed and still had dirt yards; silt fence was generally in place below the dirt yards. A large basin / wetland area was to the south. It had very well - established vegetation and almost no visible standing water. At a point on the east side, some sediment had been washed into the edge of the basin; there was no sign it had been carried all the way across the wide vegetated area. A stream ran south to the west of the wetland / basin. A walking path crossed the stream over a wooden footbridge. A smaller stormwater basin was west of the stream, with an open field south of the basin. The entire area was well vegetated and there were no signs of sediment deposits or erosion. 3 ED_019088A_00019806-00003 Another basin was in place to the southwest (at the southern end of Benjamin Lane). It was well grassed and there were no signs of discharge. Catch basins at the end of Benjamin Lane were protected with filter fabric. Houses were still under construction along Benjamin Lane; yards were not completely stabilized. There was no sign of sediment transported off site. A gravel - base staging area was north of Benjamin Lane and west of Thelma Way. A concrete wash - out pit was in place, near the road lined with plastic. A few small deposits of concrete were on the gravel pad outside of the pit; there was no sign concrete liquid had run across the staging area to the site boundary. At the north end of Thelma Way, a stormwater basin had well - established grass walls. Foundations were being excavated or constructed. A stockpile of dirt east of Thelma Way was being actively worked (a loader was putting dirt into trucks). There was a gravel trackpad between the pile and the paved Thelma Way, but the trackpad was partially covered with dirt. East of Hatherly Street, the single - family houses had walls and roofs up and appeared to be nearing completion. The yards were in the process of having sod laid in most of them. A ditch was in place along the east, downhill, side of the backyards of the houses. The ditch led to a small informal basin with a pump in place and hosing leading west. Mr. Duvall explained the hose led under Hatherly street and up to the north central basin. A large concrete outfall was near the south end of this area; Mr. Duvall explained it was only for catchbasins in Hatherly Road and did not discharge much water. There was no sign of eroding or sediment below the outfall. D. Closing Conference Mr. Spejewski and Mr. Duvall then returned to the office trailer. Mr. Spejewski confirmed that Scott Miccile, the contact on the permit NOI, was a good contact for EPA correspondence (including the inspection report). Mr. Spejewski thanked Mr. Duvall for his time and left the site about 11:30 AM.
