Introduction On August 13, 2024, the United States Environmental Protection Agency, Region 3 ("EPA") conducted an onsite Industrial User Pretreatment Inspection at Metalor Technologies (hereinafter, "Metalor"). The Facility was located at 1003 Corporate Lane in Export, Pennsylvania. The purpose of the inspection was to observe the Facility's compliance with the Pretreatment Regulations of the Clean Water Act (CWA), including the Federal Pretreatment Regulations and the National Pollutant Discharge Elimination System (NPDES) Program requirements, and applicable State and Federal regulations. The EPA is the control authority for the Facility. The EPA lead inspector was Inspector Jim Kline (Inspector Kline). Prior to the inspection, advance notification was sent to the Pennsylvania Department of Environmental Protection (PADEP). The PADEP did not have a representative present for the inspection. A. Opening Conference Inspector Kline arrived at 1003 Corporate Lane in Export, Pennsylvania on Tuesday August 13th, 2024, at approximately 10:00AM. Upon arrival, Inspector Kline immediately observed DHL Supply Chain (hereinafter, "DHL") signage posted on the building (See Attachment #1- Photos #1 - #3). Inspector Kline did not observe any signage indicating the facility was owned or operated by Metalor. Inspector Kline entered the main entrance and was introduced to Mr. Morgan Miller, General Manager at DHL. Inspector Kline presented his credentials to Mr. Miller. Inspector Kline conducted an opening conference with Mr. Miller. Inspector Kline explained the purpose and scope of the inspection to Mr. Miller. During the Opening Conference, Mr. Miller stated that DHL leased the building, occupied, and started activities in 2019. Mr. Miller stated that he was aware the former occupant of the building was Metalor, and believed they left in 2018. Mr. Miller stated the building was empty space prior to their occupation. Inspector Kline asked Mr. Miller if any equipment or tanks were left at this location when Metalor left and prior to DHL's occupation of the building. Mr. Miller stated all equipment and tanks were removed prior to DHL leasing and occupying the building. Inspector Kline asked Mr. Miller if DHL has an Industrial User Permit issued by Franklin Township Municipal Authority Publicly Owned Treatment Works (POTW) located in Murrysville. Mr. Miller stated they do not have a permit as they only discharge sanitary waste to the POTW. Mr. Miller stated at this location, DHL assembles medical equipment. Mr. Miller added that all parts are shipped to this location for assembly. Inspector Kline asked if DHL has any permits issued by local, state, or federal agencies for the activities conducted at this location. Mr. Miller stated they do not have any permits and believed that no permits were needed. Mr. Miller stated they do not generate any industrial wastes. Weather and Precipitation Conditions During the inspection, the weather was sunny with temperatures in the upper seventies (70s) degrees Fahrenheit. II. Facility Activity Metalor produced a variety of electrical components and assemblies thru powder metallurgy at 1003 Corporate Lane in Export, Pennsylvania. During a file review conducted by Inspector Kline, Inspector Kline observed a certified letter sent from Metalor to the EPA dated February 12, 2019 (See Attachment #2). In this letter, Metalor stated that their production activities ceased at this location as of December 31, 2017. The letter further stated, "as of November 16, 2018, the facility has removed the manufacturing equipment and cleanup activities were completed. The facility is now closed. This is the final compliance report." III.
