(d / b / a Goyette's Auto Parts), 1250 & 1260 Shawmut Avenue, New Bedford, Massachusetts on October 30, 2023 Dear Mr. Goyette and Mr. Cusson, On October 30, 2023, the U.S. Environmental Protection Agency Region 1 (" EPA ") performed an inspection at Goyette's Inc. located at on Shawmut Road in New Bedford, Massachusetts (the " Facility " or " site ") regarding compliance with the Clean Water Act (" CWA "). A copy of the inspection report is enclosed with this letter. Based on observations made during the inspection, EPA is requesting additional information regarding compliance with the CWA related to the Facility. Provide the below requested information to Damian Bednarz of my staff within 30 days of receipt of this letter at bednarz.damian@epa.gov. You may provide one response to this request, or separate responses based on your responsibilities as described below. 1. Regarding the Oil Pollution Prevention Regulations (40 C.F.R. part 112) A. Based on EPA's on - site compliance evaluation of the Facility, it appears an oil discharge from the site could reasonably be expected to enter nearby surface waters and therefor the Facility may be subject to 40 C.F.R. 112.1. Identify the total oil storage capacity of the Facility, and list each oil receptacle, its contents, and rated volume. If the Facility has a total oil storage capacity above the thresholds set forth in 40 C.F.R. 112.1 (d) (2) (i.e., greater than 42,000 gallons of underground capacity or greater than 1,320 gallons of aboveground capacity) state whether the Facility has a Spill Prevention, Control, and Countermeasure (" SPCC ") Plan and provide a copy of the SPCC Plan to EPA. If the Facility is required to have an SPCC Plan and does not have one, indicate by when it will provide one to EPA. 2. Regarding Permit ID MAR053149 - Multi - Sector General Permit A. The Facility's MSGP Notice of Intent (" NOI ") to be covered under the Multi - Sector General Permit for Stormwater Discharges Associated with Industrial Activity (" MSGP ") identifies Outfall 001 as the only stormwater Discharge Point at the Facility. The latitude and ED_019088A_00004294-00001 longitude of the outfall location is shown in the attached photo album on slide 2. During EPA's inspection, EPA inspectors observed stormwater flowing off - site at one additional discharge point (slide 14, 16 and 17). Submit a change NOI to include all additional Discharge Points. B. According to Part 3.1.4 of the MSGP, stormwater routine facility inspections must be done quarterly. Provide to EPA copies of the last four quarters of routine facility stormwater inspection reports. C. Provide the Facility's Stormwater Pollution Prevention Plan (" SWPPP ") as required in Part 1.3.1 of the MSGP. 3. Regarding Permit ID MAR10042K - Construction General Permit A. Dewatering activities are subject to requirements to minimize the discharge of pollutants pursuant to Part 2.4 of the Construction General Permit (" CGP "). In your CGP NOI you indicate you are not discharging dewatering water. During the inspection, EPA inspectors observed dewatering activities (slide 32, and 33). Provide more information on the composition of the water, dewatering control measures, duration, and estimated volume of discharge. If no sampling results exists, conduct sampling pursuant to Part 9.1.2.d.iv. of the CGP in order to determine if the dewatering discharge can be covered under the CGP (the effluent at zero dilution must meet numeric water quality criteria). B. According to Part 4.2 of the CGP, site inspections must be conducted at least once every seven (7) calendar days; or once every 14 calendar days and within 24 hours of the occurrence of a storm event that produces more than 0.25 inches of precipitation within 24- hours. According to Part 4.6.3 of the CGP, dewatering inspections must be conducted during the discharge once per day on which the discharge occurs. Provide copies of all inspection reports from the past six months including both site inspections and dewatering inspections and any sampling results. C.
