This report is based on information supplied by the facility representatives, inspector observations, portrelated facilities, and records including photographs taken (see Appendix 1), verbal or written statements made during or after the on-site inspection, and/or materials shown, demonstrated, or submitted to the Environmental Protection Agency (EPA) during or after the on-site inspection. In addition, information gathered prior to or after the inspection from a review of EPA, State, and public records may be included in this report. Their facility is covered under the Port of Beaumont's MARPOL COA for Annexes I and V. Area of Concern No SECTION II - OBSERVATIONS Tenant: Kinder Morgan Section: 2.1 Date: 11/05/24, 01:20 PM Contains AOC: No Contains CBI: No Lead Inspector: Vince Damiano Attendees: Phillip Camp (Operations Manager), Ethan Chick (EHS Specialist) KM is a leasing tenant inside the Port of Beaumont boundaries. KM operates as a storage terminal for aggregates, mainly handling and storing limestone aggregates. KM receives the aggregate from railcars but occasionally receives it from vessels several times a year. Once KM offloads the aggregate from inbound transportation, KM stores the aggregate on site in collection piles in the open until KM loads the aggregate onto trucks for delivery to the customer. KM was storing approximately 308,000 tons of aggregate at the time of the inspection. KM is covered under the Port of Beaumont's COA for Annex I and V, but stated they are not involved in any offloading of waste from vessels when they are removing aggregate from a docked vessel. KM does not generate any hazardous waste but is registered with the EPA (TXD008068280). Following the opening conference, the inspection team conducted a visual inspection of KM's operating areas. The inspection team observed a 6,000-gallon double-walled fuel tank on the south perimeter of the facility storing fuel for their vehicles and a conex box filled with supplies for storm relief. Next, the inspection team observed their used oil storage area. Used oil is generated from oil changes of their front-end loaders. Inside the used oil storage area, the inspection team observed one 55-gallon drum of used oil, one 55-gallon drum of used oil filters, one 55-gallon drum of used oil absorbents, and three 5-gallon containers of used oil. All storage containers were properly labeled "Used Oil" and the containers were closed and in good condition. While walking through the site, the inspection team observed three unpunctured discarded aerosol cans inside the plant trash. Mr. Camp proceeded to remove them from the trash so they could be properly disposed of (see Appendix 1 - Photo 1). The inspection team did not observe other areas of concern (AOCs) at the time of the inspection. However, further EPA review may change or add to these potential AOCs. The closing conference was conducted at approximately 02:30 PM with KM personnel. The AOC was communicated during the closing. Following the inspection on 11/6/2024, Mr. Chick sent an email to the inspection team stating that moving forward KM will utilize Waste Management LampTracker aerosol boxes for disposal of our aerosol cans and provided a receipt (see Appendix 2).
