Please see the attached congressional letter to Sec. Duffy and FHWA Executive Director Shepherd, led by Reps. Matsui, Soto, Castor, and Tonko and signed by 33 Members of Congress, citing the recent GAO legal opinion that withholding NEVI funding is illegal under the Impoundment Control Act and responding to the directive from OMB General Counsel Mark Paoletta to ignore GAO's findings. In short, Congress did not give the Executive Branch the authority to withhold or rescind NEVI funding that has been made available to the states, and Congress clearly did not intend for the Administration to retroactively disapprove or suspend approval of state plans. The Administration's actions are therefore plainly counter to Congressional intent and illegal under the Impoundment Control Act. The undersigned Members demand that DOT release the impounded NEVI funding immediately.
Please transmit this letter to Sec. Duffy and FHWA Executive Director Shepherd, and please confirm receipt.
