The inspection was unannounced and consisted of interviewing facility representatives, recording field observations, and taking photographs to document site conditions throughout the facility. Accompanying this report is Appendix A, Aerial Map, and Appendix B, Photograph Log. Opening Conference 1) On February 7, 2023, U.S. Environmental Protection Agency (EPA) contractor, PG Environmental, conducted an unpermitted industrial stormwater inspection at Lebarrons Auto Salvage (Facility) located in Dover, Pennsylvania. Page Cirillo of PG Environmental and Sean Ireland of the EPA Headquarters (collectively, the EPA Inspection Team) were accompanied on the inspection by Heather Dock, Patrick McGee, and Shawn Lesitsky of PADEP. Sean Ireland presented his Clean Water Act inspector credential to the Facility representative and conducted an opening conference. The EPA Inspection Team explained the purpose of the inspection was to document the facility's industrial activity and any obligations to apply for a National Pollutant Discharge Elimination System (NPDES) Permit (Permit). At the time of the inspection, the Facility did not have coverage under a Permit. Weather conditions at the time of the inspection were cloudy (no precipitation) with a temperature of approximately 33 F. There was no precipitation data available for Dover, Pennsylvania. Yes No FACILITY'S OPERATION & PRODUCT DESCRIPTION The Facility is approximately 12 acres of outdoor storage for salvaged vehicles. The Facility includes two (2) buildings: the main office to the west and an additional indoor work area to the east. Additionally, the EPA Inspection Team observed three (3) shipping containers used to store salvage vehicle parts located just east of the main office building. Industrial activities (e.g., storage of salvaged vehicles and parts, receiving and processing of new vehicles for salvage, salvage vehicle crushing for disposal) were observed to occur outside and were exposed to stormwater. The EPA Inspection Team observed parts stored in the indoor work area to the east and a vehicle crusher in the northeast corner of the Facility. The Facility representative stated vehicles are drained of fluids indoors. Oils are burned on-site for indoor heating while fluids like antifreezes are sold. The 5015 SIC code for Motor Vehicle Parts, Used, was determined using the EPA ECHO Facility Finder. Other industrial facilities owned/operated by same business entity? Yes No SECTION II - OBSERVATIONS SITE EVALUATION Pollutant Sources Observations Loading/Unloading Operations Industrial Manufacturing/ Processing Operations Industrial Machinery & Equipment Storage Storage of Industrial Materials or Products The Facility representative explained that cars received are unloaded from trucks that access the Facility using the main entrance off Zeigler Road. The Facility then uses on-site equipment (e.g., forklifts) to move salvage vehicles around the Facility. Crushed cars are removed from the Facility and hauled offsite. Draining vehicle fluids and partial vehicle dismantling for resale. The EPA Inspection Team observed a salvage vehicle crusher in the northeast corner of the Facility (refer to Appendix B, Photographs DSCN1309, DSCN1310, DSCN1311, & DSCN1312). The Facility stores approximately 1,000 salvage vehicles, parts, scrap metal, and tires outside and exposed to stormwater. The parts and scrap metal were primarily located near the rear of the main office building (refer to Appendix B, Photographs DSCN1292, DSCN1293, DSCN1294, DSCN1296, DSCN1292, DSN1293, & DSCN1297). The tires were located in the central area of the Facility around the main office and also by the salvage vehicle crusher (refer to Appendix B, Photographs DSCN1294 & DSCN1311). Salvage vehicles were stored adjacent to an unnamed tributary to Conewago Creek, which runs through the center of the Facility from east to west (refer to Appendix B, Photographs DSCN1300, DSCN1324, DSCN1325, DSCN1331, DSCN1332, DSCN1333, DSCN1334, DSCN1335, DCN1336, & DSCN1337). The Facility representative stated that vehicles are drained of fluids indoors (excluding windshield wiper fluid which remains in the vehicles). The Facility burns waste oil in a waste oil furnace. The EPA Inspection Team observed salvage vehicles still containing windshield washer fluid in many of the vehicles throughout the storage area (refer to Appendix B, Photograph DSCN1305). Liquid Storage (e.g., Tanks, Liquid Storage Drums) The EPA Inspection Team observed approximately thirty (30) 55-gallon drums located outside the main office building and indoor work area (refer to Appendix B, Photographs DSCN1290, DSCN1293, & DSCN1296). At the time of the inspection, a few of these drums were observed to have an unknown liquid in them. The rest of these drums were empty. All drums were observed to be unmarked and without cover or containment. Waste Storage/Disposal Areas (solid and/or hazardous) Waste Treatment Facilities (e.g., Pretreatment Systems) The EPA Inspection Team observed three (3) oil tanks at the Facility. One was located by the salvage vehicle crusher (refer to Appendix B, Photograph DSCN1313), which was empty, unmarked, and without containment or cover. The two oil tanks by the main office building (refer to Appendix B, Photograph DSCN1293, DSCN1295, & DSCN1296) both contained liquids, one of which was labeled as used oil, and neither of the oil tanks were in containment nor under cover. The EPA Inspection Team observed salvage vehicle parts stored inside shipping containers (refer to Appendix B, Photograph DSCN 1292), as well as salvage vehicle parts and tires outside north of the Facility's office (refer to Appendix B, Photograph DSCN1294). Additional salvage tires were stored adjacent to the vehicle crusher (refer to Appendix B, Photographs DSCN1311). None observed. OUTFALL, STORMWATER DISCHARGE & RECEIVING WATER OBSERVATIONS Number and description of each potential Stormwater Discharge Point from the Facility The EPA Inspection Team observed at least four (4) discharge locations from the Facility to the unnamed tributary to Conewago Creek running through the Facility (refer to Appendix A, Figure 1, and Appendix B, Photographs DSCN1300, DSCN1301, DSCN1302, DSCN1303, DSCN1331, & DSCN1332). Evidence of pollutants migrating offsite (stains, deposits, ponding) at discharge points, into Receiving Waters or in MS4 The EPA Inspection Team observed orange-colored ponded water south of the unnamed tributary to Conewago Creek running through the Facility property (refer to Appendix B, Photograph DSCN1304). The coloration was consistent with that of typical iron oxidizing bacteria. The EPA Inspection Team observed debris around the unnamed tributary to Conewago Creek running through the Facility (refer to Appendix B, Photographs DSCN1332 & DSCN1334). The majority of the Facility is sloped inward towards the center of the Facility, such that stormwater runoff discharges to the unnamed tributary to Conewago Creek running through the Facility from east to west. The northern portion of the Facility slopes such that stormwater runoff discharges to the unnamed tributary to Conewago Creek running along the northern and western Facility border. The western portion of the Facility slopes south, such that stormwater runoff discharges to the unnamed tributary to Conewago Creek running through the Facility. The unnamed tributary to Conewago Creek running through the Facility meets with the other unnamed tributary running along the northern and western Facility borders (refer to Appendix A, Figure 1). The majority of the Facility's ground surface was observed to be compacted gravel with some areas having exposed soil or vegetation. The area surrounding the main office building and indoor work area was paved (refer to Appendix B, Photographs DSCN1293, DSCN1298, DSCN1305, DSCN1319, DSCN1320, DSCN1327, DSCN1329, & DSCN1330). There was one storm drain between the main office building and indoor work area without inlet protection. Petroleum product staining, salvage vehicles, and debris were observed around the inlet (refer to Appendix B, Photographs DSCN1290 & DSCN1291). The Facility representative was unsure of the storm drain's outlet/connection. SECTION III - AREAS OF CONCERN 1) The EPA Inspection Team observed the storage of salvage vehicles and parts for resale at the Facility, an industrial activity classified under SIC Code 5015 - Motor Vehicle Parts, Used. a. Businesses classified under SIC Code 5015 are regulated under 40 C.F.R. 122.26 for stormwater discharges associated with industrial activity. b. Industrial activities observed occurring outside and exposed to stormwater at the time of the inspection included receiving and processing new vehicles for salvage, storage of salvaged vehicles and parts, and salvage vehicle crushing for disposal. Salvage vehicles were stored adjacent to the unnamed tributary to Conewago Creek (refer to Appendix B, Photographs DSCN1293, DSCN1298, DSCN1300, DSCN1305, DSCN1319, DSCN1320, DSCN1325, DSCN1327, DSCN1329, DSCN1330, DSCN1332, DSCN1333, DSCN1334, DSCN1335, DSCN1336, & DSCN1337). c. The Facility did not have coverage under a Permit at the time of the inspection. 2) The EPA Inspection Team observed salvage vehicles still containing windshield washer fluid in the outdoor salvage vehicle storage area (refer to Appendix B, Photograph DSCN1305). 3) The EPA Inspection Team observed approximately thirty (30) 55-gallon drums located outside the main office building and indoor work area (refer to Appendix B, Photographs Page 6 of 7 MULTI-SECTOR GENERAL PERMIT NON-FILER INSPECTION CHECKLIST Lebarron's Auto Salvage Inspection Date: February 7, 2023 DSCN1290, DSCN1293, & DSCN1296). At the time of the inspection, a few drums behind the main office building were observed to have liquid inside them. It was unclear and EPA did not infer what type of liquid was inside. The rest of the drums were empty. All drums were unmarked and without cover or containment. 4) The EPA Inspection Team observed three (3) oil tanks at the Facility. One by the salvage vehicle crusher (refer to Appendix B, Photograph DSCN1313), which was empty, unmarked, and without containment nor under cover. The two oil tanks by the main office building (refer to Appendix B, Photographs DSCN1293, DSCN1295, & DSCN1296), both contained liquids, one of which was labeled as used oil, and neither of the oil tanks were in containment nor under cover. 5) The EPA Inspection Team observed orange-colored ponded water south of the unnamed tributary to Conewago Creek running through the Facility property (refer to Appendix B, Photograph DSCN1304). The coloration was consistent with that of typical iron-oxidizing bacteria. SECTION IV - CLOSING CONFERENCE After the site walk, the EPA Inspection Team met with the Facility representative from Lebarron's Auto Salvage for a closing conference and shared preliminary observations. The EPA Inspection Team reiterated that all preliminary observations discussed were not compliance determinations. Any and all preliminary observations shared were subject to further investigation by the EPA Inspection Team. Additional observations may be contained in this inspection report that were not identified at the time of the closing conference. The inspection concluded at approximately 12:15 PM (EST).
