Below is a statement that you may attribute to me: "Mr. Kelly made proper disclosure of the FDIC dispute and has complied with all ethics requirements. He is, and will remain, a paid EPA employee as he continues to conduct critical work to improve Superfund cleanup." - Amy Graham, EPA spokesperson Thank you, Amy Begin forwarded message: From: Paul Monies <PMonies@Oklahoman.com> Date: August 25, 2017 at 12:44:34 PM CDT To: "Lincoln Ferguson (ferguson.lincoln@epa.govy1 <ferguson.lincoln@epa.gov> Subject: Superfund/Kell Kelly FDIC question--The Oklahoman Hi Lincoln, Good to hear from you. I actually just left you a voicemail on your office line because I'm following up on a couple of orders from the FDIC regarding Albert Kelly and his time at SpiritBank. It appears Mr. Kelly has agreed to a consent order and will pay a penalty of $125,000. In addition, he has been issued a prohibition notice from future banking activities from the FDIC. The orders are here on the FDIC website: https://www5.fdic.gov/EDOBlob/Mediator.aspx?UniqueID=a4b0fd59-5e72-449b-bl758eO32 17cv1906 Sierra Club v. Did Mr. Kelly make EPA Administrator Pruitt and other EPA personnel aware of his pending FDIC complaints before he was selected to chair the Superfund Task Force? 2. Is Mr. Kelly a paid EPA employee for his role as senior advisor to the Administrator? 3. Did Mr. Kelly have to complete any publicly available ethics/background forms to be a senior advisor? If so, can you send me any copies of such forms? 4. Would these FDIC actions preclude Mr. Kelly from continuing in his role as a special advisor to the Administrator or as chairman of the Superfund Task Force.
