Strickland reviewed with the attendees the Board's Federal regulatory advocacy activities. The overall report will consider the desired outcome, our current practices and recommended methods to close the gap between the two. Three studies are being conducted by a control group: A survey of regulatory agencies; A survey of CMA members; and possibly An economics study for setting priorities. CMA 060992 The executive officers will be briefed next week on surveys to be conducted as part of the study. It was noted that our ability to have an early effect on an issue is directly tied to available resources, and how early we become involved in an issue. 2.2 P.M. King reviewed with the attendees the EMC's case studies that includes OCPSF, Air, RCRA and SARA 313. He reported that some studies indicate well planned and coordinated activities, however, the committees must think proactively on upcoming issues. 2.3 It was noted that the regulatory advocacy effort is tentatively scheduled to be completed by June, 1990, with a back-up date of November, 1990. (The last regulatory advocacy minutes are attached) 3.0 EPA Clean Air Act Amendments Implementation Plans -- L.D. Johnson L.D. Johnson reviewed with the attendees a reorganization of the air task group to keep up with the new Clean Air Act amendments. There will be two air task groups -- Air Legislative Issues Task Group and the Air Issues Task Group. February 20, 1990 Joint EMC/HSC Meeting Page 3 4.0 Development of Title III Legislative Positions - T. Casey T. Casey asked the attendees for ideas on Title III legislative issues, and a possible need for structuring task groups for upcoming activities. He also discussed environmental issues on Title III: - offsite transfer reporting; - listing/delisting; mass balance reporting; - voluntary waste minimization reporting; emergency actions portion of SAHA; - peak release reporting; - developmental/neurtox issues; environmental issues; and It was agreed that a joint HSC/EMC ad hoc group is needed to identify Title III issues. The CAER Task Group will be responsible for health issues, and the Reporting Issues Task Group under Waste and Release Reduction (WARR) will be responsible for the environmental issues. 5.0 Imposed Risk Project -- J. LeBeau J. LeBeau reported on activities the ad hoc Imposed Risk Work Group. He reported that the group has met three times and will focus on all aspects of risk assessment and managment - not just the technical aspect - and defined the group's activities in several categories: o Technical Focus - considering technical aspects of risk, risk models, etc. Communication Focus - a work plan for a risk education workshop will be developed before the next joint committee meeting, and a possible risk communication program to work on risk issues. Societal Economic Focus - in progress to try and find relevance in areas of risk, and industry's role and how such issues are perceived by the public. o Governmental Focus - looking at government risk management actions and issues. Using a third party group to identify key persons and an appropriate agenda is believed to be an essential element of the project. A conference call to put together a work plan on risk with top leaders (that may include Lee Thomas, former EPA Administrator) is scheduled for early March. 6.0 Risk Alternatives The group reviewed a propose policy on product composition. It includes: CMA 060993 February 20, 1990 Joint EMC/HSC Meeting Page 4 - product risks weighed against product benefits and weighing the risks and benefits of a current substances against those of any proposed alternatives; - restrictions that Impose least burdensome controls; and - adequate procedural safeguards. 7.0 Review of Responsible Care 7.1 The attendees reviewed Responsible Care plans of both committees. HSC shared general plans to develop the product stewardship code and the employee safety code. 7.2 The attendees reviewed VARR developments and discussed the comments and concerns of the Code of Management Practices. A consensus was noted, and that the Code is being sent for Board approval in April. 7.3 The attendees reviewed the Waste Management Code of Practices (WAME) by focusing on good "management" practices.
