The problem is the chemicals for these PMNs are created in situ by our downstream customers, 99% of which are part of a larger distribution supply chain. These downstream users cannot manufacture the asphalt emulsions until the SNURs are published in the Federal Register and we have met the terms of our CO agreement. The use season for these substances coincides with construction season (spring and summer months), and we are at risk of losing the entire 2018 season if the SNURs are not published fairly immediately. Is there any indication of when these will be signed and sent to the Federal Register? We have customers that are looking for confirmation to when or if we will be able to provide product this season. Right now the uncertainty is hurting us more than a negative definitive response.
