PLAINTIFF'S EXHIBIT c Minutes of the Meeting of the HEALTH A SAFETY COUNCIL/ACFA November 14, L968 A meeting of the members of the Health A Safety Council of Che Asbestos Cement Products Association was held pursuant to notice at the Board Room of The FLintkote Company201 East 42nd Street at 9:30 A.M. on November 14, 1968. Cypsum Atlantic Asphalt & Asbestos Davies, Hardy, Loeb, Austin & Ives Mr. Fay, as President of ACFA, opened the meeting with a few introductory remarks and noted the long involvement of the ACPA in thee industry. He recited the concern of the Association in possible problems involving health end asbestos. The seminars held at the offices of Johns-Manvllle during the sumet demonstrate to the asbeseos cement manufacturers ehe size of such problems, end have lead to the creation of this Health A Safety Council. Mr. Fay stated that the Council was not created to undertake research projects. Fay announced that he and the board of Directors of the ACPA had unanimously requested Mr. Main of The Filr.Ckote Company to serve as Chairman of this Council. S. Gypsum. Tha report of the interim treasurer was accaptad as prasented. Mr. Main called upon Mr. Scheekler of J-i; to report an the proposed pamphlee entitled'Recommended Health Safety Practices For Handling And Applying Asbeseos Cement Products". Mr. Scheekler stated that ehe proposed pamphlet was designed to supplement tvo booklets already Issued by the National Insulation Manufacturers Association. One of chase booklets concerned thermal insulation products containing mineral fibers and the other concerned thermal insulation products containing asbestos fibers. The intent of issuing these booklets to contractors by ehe members of NIKA was to procece their employees and chcmselvcs legally. The present draft booklet on handling and applying asbestos cenenc produces has been delayed until Chit Council was organiad. Mr. Scheekler noted thae the booklet was designed for contractors and chose at job sites who handle asbestos cement materials. He noted ehae the booklets prepared by NIMA were not intended for workers per se although ehe unions concerned were given copies. Mr. Scheekler stated that the proposed booklet on asbestos cement products might be given to Job foremen. During discussion of the draft pamphlet, it was noted that the contractors who handle asbestos cement products may be * too numerous In the siding field for effective distribution although contractors handling corrugated materials might not be. Same inquiry was made as to the possibility of limiting distribution to the operating branches of the industry while others indicated that distribution should be made to the users. During discussion, it was noted that there were cases in corsrau law negligence (outside of Workmen's Compensation) presently pending in several 'urUdtctlons. The indication was that health probl-i involving asbestos cement products were resulting in a growir* amount of litigation. Because the /.sbestosls Research Council of England puts ouC p^phlecs which relace to each specific use of asbestos, srahers of the meeting felt that Che present draft was too general, and it a3 rated that each product containing asbestos cty have probUns peculiar to that product. A notion was node and seconded that the Chairman appoint a ccrrittee to consider booklets and that any booklets issued by this .v.-niccee be related to the end use of the products. Main discussed further with the Council che areas of corrrunicseions and public relations; che possibility of distri buting reports on che findings of chis Council and of its subcoealctees; che legal and Insurance aspeecs of health problems Involving asbescos ceacat produces and che need of all members co be kept informed on developments in each field. The meeting considered the funding of the Council and decided that initially budget should be prepared which would provide for basic expenses. Ie was agreed that special projects pursued by che Council would be funded by special assessieencs. It uas also agreed chat each representative would be responsible for his -own luncheon bill and Incidental expenses attendant upon each meeting. Ie was Che consensus chat Che Council should meet quarterly during its inaugural stage. The following target dates were esta blished for Meetings to be held ee ehe Hotel Biltnore in New York City an Che following Tuesdays: February 16, 1969, May 20, 1969, August 19, 1969 and K'ovesber 18, 1969.
