I hope you are well! As I think you are aware, I represent the American Exploration & Production Council (AXPC) which is comprised of the 34 largest independent oil and gas producers in America, (www.axpc.us)
You may also recall that given our earlier meeting with Lee Forsgren, AXPC is very interested in having the Agency reconsider the Effluent Limitations Guidelines and Standards for the Oil and Gas Extraction Point Source Category (ELGs for UOG), which imposed a "zero-discharge" standard on wastewater from unconventional oil and gas extraction under the CWA.
We understand from court filings that the rule has been remanded to the Agency in its entirety. This is an optimal time for the Agency to either repeal or revise the ELGs for UOG, and not simply undertake a "quick-fix" on the definition of the rule. As you know, we had the opportunity to meet earlier this year with Lee Forsgren, and would appreciate the opportunity to come in and discuss this matter further with you. [We had initially planned to wait until David Ross was confirmed, but recognize that time may be of the essence given the remand and the up coming court status conference. If the Agency intends to await his arrival to make any decisions on this matter, we would be happy to wait and discuss it with him at that point.]
