Asa Defendant in a class action lawsuit pending against DuPont in the West Virginia State Court in which we serve as Class counsel, DuPont has the right to mark documents produced in that case as falling underthe termsofthe Stipulated Protective Order that allows parties to limit distributionof documents,ifthey qualify as documents for which "confidential business information" (CBI), protection would be available under, among other provisions, 40 CFR. Part 2, Subpart B. Although DuPont originally marked this document as confidential under that Order, DuPont has since confirmed in writing that it has withdrawn its confidentiality claim with respect to this report. Exhibit B to this setofDuPont's discovery responses has been removed, because the document has been marked "confidential" under the termsofthe Stipulated Protective Order referenced above in Footnote 1. We are currently challenging DuPont's confidentiality claim with respect to that document but the issue has not yet been resolved.
