EPA and Army Seek Additional Pubiic Comment on `Waters of the U .S .' Repeal
WASHINGTON (June 29, 2018) - The U.S. Envi ronmental Protection Agency (EPA) and the Department of the Army (Army) are issuing a supplemental proposal to the July 2017 proposed action to repeal the 2015 defi ni ti on of "Waters of the Uni ted States" (WOTUS). T o d a y 's proposal speci fi cally requests comment on the 1egal basis of the 2015 WOTUS rule, which the agencies believe has 1ed to uncertainty and confusion across the country.
"By issuing today's supplemental proposal, we are respondi ng to public feedback, expandi ng opportuni ti es for comment, and providi ng clari ty and transparency in the rulemaking process," said EPA Admini strator Scott Pruitt."We are maki ng it cl ear that we are proposi ng to permanentl y and completely repeal the 2015 WOTUS rule and keep the pre-2015 regulatory framework in pi ace as we work on a new, improved WOTUS defi ni ti o n ."
During 1ast summer's public comment period, the EPA and the Army heard from hundreds of thousands of stakeholders about the proposal to repeal the 2015 defi ni ti on of W O T U S . After revi ewi ng thi s input, the EPA and the Army are issui ng a supplemental noti ce of proposed rulemaki ng to cl ari fy that the agenci es are proposi ng to permanently repeal the 2015 rule in its enti rety. As part of the ini ti al proposal, the EPA and the Army indi cated thei r intent to recodi fy the pre-2015 regulations-a 1ongstandi ng regulatory framework that is currentl y bei ng admi ni stered by the agenci es-to keep them in pi ace unti 1 the agencies fi nali ze a new defi ni ti on of W O T U S .
The agenci es are also issui ng the supplemental noti ce of proposed rulemaki ng to give the public an opportuni ty to comment on addi ti onal consi derati ons that support the agenci e s ' proposed repeal, some of whi ch the agenci es di d not di scuss in detai 1 in the ini ti al proposal.
"Thi s supplemental proposal reflects our conti nued commi tment to common sense in the rul emaki ng process," sai d R.D. James, Assi stant Secretary of the Army for Civi1 Works.
The agenci es are conti nui ng to revi ew the comments recei ved on the July 2017 proposal and will be accepting public comment on the supplemental proposal for 30 days after it is published in the Federal Regi ster. Commenters do not need to resubmi t comments already provi ded to the agenci es in response to the July 2017 proposal.

Background
The EPA and the Army are working through a two-step process to consider revisions to the definition of "waters of the Uni ted States," consi stent with the February 2017 Presi denti al Executi ve Order 13778. The Executive Order states that it is in the nati onal interest to ensure that the nati o n 's navi gable waters are kept free from pol1uti o n , while at the same ti me promoti ng economi c growth, mi ni mi zi ng regulatory uncertainty, and showing due regard for the roles of Congress and the states under the Constitution.
