Rochester, New York 14603 Dear Mr. Britton: I send herewith a bill to cover the expense of my trip, to Washington, and a bill for the day spent on behalf of your company. It would serve my purposes best, primarily from the aspect of the Federal Income Tax, if you were to issue two checks, one for my expenses made out to me, and the other for consultation issued to Kettering Laboratory. For several reasons, I make it a matter of policy to regard all consultations of this type that arise out of the work of the Laboratory, as being done by a staff representative of the responsible group in the Laboratory for the Laboratory. Hence payments are due the Laboratory. Since I have given you the results of my interview with officials in Washington, there is little I need add, except to emphasize one point, below. The issue both in equity and law, in a situation of this type, as I was able to establish the situation yesterday, is that a contaminant of food becomes an additive, when it arises out of an industrial process involving food, and it cannot be tolerated tinless there is an adequate reason, in terms of a real hygienic or nutritional advantage to the public. That there may be an economic factor, is of no consequence under the law. It may be that there is some factor of cleanliness or preservation in the course of processing and storing foods. If so, it could be presented as a reason for accepting the slight disadvantage of an added trace of lead.
