The intent of the biodegradation exclusi on for the polymer exempti on was for polymers that undergo substanti al degradati on under normal condi ti ons of use or di sposal. In thei r di scussi o n , the Agency acknowledged that essentially al1 polymers degrade or decompose to a 1imi ted degree over ti me and gave examples of polymers in 1andfi11s and stated that the exclusi on was not intended to address such degradati o n . If the polymer is designed or reasonably antici pated to substantially degrade then they would be excluded from the polymer exempti o n . Substanti al bi odegradati on in a waste treatment system (readi1y bi odegrabi1ity test whi ch si mulates a waste water treatment pi ant) would render a polymer inel igi bl e for the exempti o n . The questi on I have is: to assess the degradabi1ity of a polymer for potenti al polymer exempti o n , a reasonable assessment would be the Readily biodegradabi1ity test? Aerobic composting is not a reasonable assessment of the degradabi1ity potenti al of the materi als for the polymer exempti on si nee thi s method of di sposal generally are restri cted to y a rd, food and farm wastes wi th only a smal1 amount of industri al wastes reported to be composted. The fate of the materi al in 1andfi 11s will inform the cradle to grave assessment and potenti al fate of the material but should not be used to assess the materi al for polymer exemption.
