Section I - INTRODUCTION
Pinch A Penny Pool Patio Spa Inspection Date 1/13/2026
PURPOSE OF THE INSPECTION
I, EPA Region 6 inspector Lee McMillan accompanied by inspector Kiera Hancock began an investigation based on a follow-up to a tip and complaint submitted to the agency. I arrived at the Pinch A Penny Pool Patio Spa Store 280 (Pinch A Penny) at 9:45 AM on January 13, 2026, for an unannounced inspection. I presented my credentials to Mr. Derek Heron and informed him that I was there to conduct an EPA inspection to determine compliance with the Federal Insecticide Fungicide Rodenticide Act (FIFRA). The scope of the inspection would be to review documents and any pesticide products for evaluation of the compliance with FIFRA (40 CFR Subpart 169.3 - Inspections).
FACILITY DESCRIPTION
Pinch A Penny Pool Patio Spa Store 280 is based in League City, Texas. Pinch A Penny is America's largest franchised retail pool supply and service company. The company began in 1975. In December 2021, Pool Corporation acquired Pinch A Penny as part of the Porpoise Pool & Patio, Inc. acquisition. Store 280 has 7 employees. Pinch A Penny, LLC is based in Clearwater, Florida. The company has annual revenue of approximately $9.74 million.
Section II - OBSERVATIONS
On January 13, 2026, I met with Mr. Derek Heron and discussed the company's business. At approximately 9:57 AM, I toured and inspected the Pinch A Penny store. During the investigation I viewed the Showroom Floor, Chlorine Room, Service Room, and Bulk Chlorine Area. I was informed that the store received its liquid chlorine solution into the outside bulk tanks about every 1-2 weeks. The store has a double valve safety system from the outside bulk tanks to the Chlorine Room where containers are filled.
Multiple photos were taken during the inspection of the facility (Appendix 1: Photograph Log). With the assistance of Mr. Heron, a sample was taken of the Liquid Chlorinating Product (EPA Reg. No. 37826-3) using one of the stores service jugs. An approximate 1-gallon sample was taken and marked with sample number 1-13-26-177910-01-01-LM. Chain of custody seals were applied for shipment (Photos 21 -25).
Section III - AREAS OF CONCERN
I conducted a closing conference with Mr. Heron at 10:45 AM on January 13, 2026. There were no areas of concern found during the inspection. I concluded the inspection and exited the facility at 10:47 AM.

Section IV - FOLLOW UP
Pinch A Penny Pool Patio Spa Inspection Date 1/13/2026
The sample taken during the inspection was shipped to the EPA Laboratory in Fort Meade, MD for testing on January 13, 2026. The testing results received on March 5, 2026 indicated that the Pinch A Penny Liquid Chlorinating Product (EPA Reg. No. 37826-3) met the label active ingredient standard of 10.5% Sodium Hypochlorite. No additional concerns were found, and no additional information was requested.
