SUMMARY OF THE RULES AND REGULATIONS TO RECALL AND REPURCHASE A BANNED HAZARDOUS SUBSTANCE Manufacturer shall repurchase it from the person to whom the manufacturer sold it and shall (1) Refund that person the purchase price paid for the article (2) Reimburse that person for any reasonable and necessary transportation charges and expenses paid by that person in the return of such articles- Manufacturer shall immediately notify each distributor, dealer, and other per sons to whom the manufacturer has sold that product that it is a banned hazardous substance subject to repurchase under the act. (1) Notice will identify the article involved including model number or other distinguishing characteristics (2} Set forth the nature of the hazards involved in the use of the product (3) Provide instructions for return or other disposition of the product (4) Advise that any distributor or dealer who receives the notice is re quired to provide further notice as specified. .Distributor shall, in the same manner as above, notify each distributor, dealer, and other persons to whom the distributor has sold the article- Dealer shall immediately do the following: , r (1) Prepare and prominently display a list captioned "Banned Articles or Substances List" which shall contain identification of the banned product including the model number or other distinguishing char acteristics and the name and address of the manufacturer. (2) Date the notice was received from the manufacturer or distributor (3) Nature of the hazards involved with the use of the product (4) List must be posted for a period of not less than 120 days from the date dealer received the notification. Iu the case of a person who has purchased an article or sub stance front a dealer and who returns it to that dealer, the dealer shall reload the purchase price paid and reimburse the purchaser for any reasonable and necessary transportation charges in curred iu Its return. (D As soon as the manufacturer of an article or sub stance knows or receives information from which the manufacturer should know that the article or substance .is a banned hazardous substance, the manu facturer shall immediately notify each distributor, dealer, and other person to[ whom the manufacturer has sold that product that it is a banned hazardous substance subject to repurchase under the act. This notice will identify the arti cle or substance involved (including model number or other distinguishing characteristics), set forth the nature of the hazards involved irr the use of the I product, provide instructions for return or other disposition of the product, and advise that any distributor or dealer who receives the notice is required to provide further notice as specified in this para graph. The propellent unloading facilities, includes .a Corken Mo. 1021 Vane pump at 520 rnr, with 7.5 HP motor and a Corken compressor No. 490-107, with 10 HP motor for both hydrocarbon propellents and Genetron unloading and vapor heel recovery. The system was designed and contracted by the Phillips Petroleum Co, We.recommend the installation of an additional vapor line from the compressor T/C side to the T/T unloadina spots (about 120 feet) to permit recovery of vapor heels from T/T deliveries. The recovery from the first T/T delivery should cover the cost of this additional line. These facilities should be in operation within the next few weeks. Our records indicate that Plasti-Kote consumes approximately four million lbs. of Acetone and that this has been divided between Ashland and other suppliers. We have been a supplier to Ashland's Cleveland location, and it is our Intention to continue shipping in 1974. While our sales will be drastically reduced due to our overall shortage of product it is not in our plan, at least at the present time, to discontinue sales completely. Acetone is one solvent that v/e cannot do without if we are to continue to manufacture even at our present reduced level, I am sure that you can see what effect your company's decision to discontinue the sale of acetone to Ashland Chemical had on Plasti-Kote, Plasti-Kote purchased between 60% and 75% of the acetone that Allied Chemical supplied Ashland. I am obviously in no position to criticize your company's decision and I realize that under today's conditions, business decisions of this type have to be made. However, I must point out that Allied was fully aware that FlastiKote was Ashland's principal customer for acetone, and in my opinion, has an obli;gation to co*utinue to serve Plasti-Kote, either directly or through another distributor. As things nov/ stand, it is possible that we. will not have enough acetone to continue our present Ic-vel of operations past the 2Sth of January. Ashland has agreed to do everything possible to give us what they can. but at this writing, the outlook is far from bright. Joe, I sincerely feel that Allied Chemical has an obligation to continue to supply Plasti-Kote, since we have always been a customer, even though we purchased our acetone through your distributor, Ashland Chemical. Please under stand that I am not pleading Ashland's case, although they have always been affine supplier and are conveniently located in Northern Ohio. * Our usage of acetone runs between 45,000 and 60,000 gallons per month, depending upon whether we are in a five week or four week month; the first month of each quarter, being a five week accounting period. So you can see, v/hat effect the loss of 12,000 to 15,000 gallons will have on our operations. In closing, I would once again like, to emphasize that the situation is critical and time is of the essence. Plasti-Kote and Allied Chemical have had a long and I hope, mutually profitable association and 1 cannot believe that management was fully aware of the impact on Plasti-Kote when it made its decision to discontinue the services of Ashland Chemical. This would bolt between the tank nostrle and the existing 2* flanged valve. This unit appears to have a greater open area than the 2?* Rago 3293~ or B. FDA promulgated regulations last year to take effect January 1, 1973 and January 1, 1974. As of January 1, 1973, no paint or coating intended to be used in and around the household can contain more than 0.5 percent lead in the dried film. According to attorneys for NPCA, Federal Law cannot be pre-empted on labeling? however, they can on standards providing the State or City standards are at least as stringent as the Federal. In other words, H.Y. City could set a standard of 0.2% lead in paint, but in no case could a standard greater than 0.5% be established. Also enclosed are copies of the Federal Law. When all this gas is released from opening the container, the volume would be less than the volume of fluorocarbon if a hair spray was sprayed for a period of two seconds." Users of hair sprays discharge more than this quantity in normal use. Therefore, the volume of fluorocarbon gas in the air is much greater (in the order of 10-50 times greater) than carbon dioxide coming from the beer can or soda bottle. Further, although the Underwriters Laboratories classi fied carbon dioxide as Group 5A, i.e., lower than 6, we can find no good justification for this. The health of one group exposed continuously to 3% CO2 (30,000 ppm) was only slightly affected. The American. Conference of Governmental Industrial Hygienists has set the Threshold Limit Value (TLV) for CO9 at 5,000 ppm vs. 1,000 ppm for GENETBQN 12. We doubt that either of these values .T is too meaningful because neither is harmful at concentrations ^ encountered in normal use provided oxygen supply is not deficient As you know, propellant 12 has been reported as the cause of deaths via the deliberate abuse of aerosol products, whereas carbon dioxide is usually described as a simple asphyx iant. Accordingly, while we too are very concerned at the half. / truths in the Anderson column, we believe that an attack on CQ2^ would not provide a strong enough basis. Recently Allied took part in two meetings held in Washington, D.C. The first was a joint meeting of interested Government officials and industry manufacturers. I have expressed my indignation to the public relations director of Consolidated Foods, with a request for suggested action. You and I are aware of the measures being attempted by both CSMA and NPVLA in this connection, and I imagine you share my conclusion that not much has been accomplished to date.. Seeking specific rebuttal to the Jack Anderson libel, it occurs to me that a company with your research facilities could produce some facinating data suf ficiently interesting to receive wide-spread acceptance as editorial material, despite the current anti-business attitude of all the news media. In my letter to Con Foods I pointed out that everything in this world can be used in a deadly fashion, and that death can be induced by drinking too much pure water, for example. The specific thought I had in connection with Jack AndersonTs article and Grace Lichenstein's recent article^in the New York Times would take the following approach: Freon gas is actually one of the most inert and harmless gases in general use today. As a matter of fact, it is probably quite comparable to carbon dioxide ? in this characteristic. Carbon dioxide is actually a very innocuous substanceJ yet in sufficient concentrates it, like everything else, can kill. Anderson makes a big point of the fact that in utilizing aerosol products <-- specifically in his case hair spray, a certain amount of Freon is released in the vicinity of a human head. Every time a can of beer or a bottle of Coca-Cola is opened carbon dioxide is released in the vicinity of the human head. Certainly, if a person empties an entire can or bottle of beer into a glass as they do on TV commercials, with the great burst of gas and bubbling of foam, the quantity of gas escaping right under the nose of the consumer almost has to approximate the amount released in a typical application of hair spray. Your laboratory people will know whether or not this comparison has merit. Wouldn't you agree, that if it does, there would be lots and lots of columnists and newspapers who would pick it up. I doubt that there are many who would care to say anything in defense of an industry, but they might well pick it up as a means of attacking another industry -- brewing and soft drinks, and whereas I have no wish to spread these senseless attacks on business, at the moment it appears that our only defense is to make these attacks look ridiculous which this kind of publicity would tend to do. Stimulation is pronounced at 5% (50,000 ppm} concentration. The health of sub marine personnel exposed continuously to 3% carbon dioxide was only slightly affected provided the oxygen content of the air was maintained at normal concentrations (1); when oxygen content was reduced to 15-17%, a variation in effects occurred according to duration of exposure. Impairment in general occurred at lower oxygen levels when exposure persisted over days and weeks. Deaths from carbon dioxide have been reported (2), but these were asphyxiating concentrations, probably several hundred thousand parts per million. The gas is weakly narcotic at 30,000 ppm (3) giving decreasing acuity of hearing and increasing blood pressure and pulse. Above this level subjective symptoms occur; at 50,000 ppm a 30-minute exposure produces signs of intoxication, and 70,000 and 100,000 ppm, unconsciousness In a few minutes. Flury and Zemik (4) quote Lehman-Hess that 5500 ppm CO^ for 6 hours causes no noticeable symptoms. The threshold limit of 5000 ppm for carton dioxide would appear to provide a rea sonably good margin of safety for an 8-hour daily exposure, provided ordinary amounts of oxygen are inhaled. Its effects are largely on the nerv ous system; single exposures are characterized by narcosis and its sequelae. Symptoms of repeated exposure are nervousness, irritability, indigestion, bizarre dreams leading to insomnia, excessive fatigue, loss of appetite, and headache (1). ; Wiley and associates (2) exposed animals repeatedly to carbon disulfide at 37 ppm and found significant toxic effects. They recommended that atmospheric concentrations be kept below 32 ppm. It is now recognized that the neural responses to CS? are greatly influenced by the mineral content of the diet, at least in a'nimals (3); a highly min eralized diet exerts substantial protection against the neural effects of CS . Fatty's review (4) cites data to the effect that exposure of men to 160 to 230 ppm causes slight or no effects, 320 to 390 ppm causes slight symptoms after several hours,. 420 to 510 ppm causes symptoms after h hour, .1150 ppm causes serious symptoms after/** hour, 3210 to 3850 ppm is dangerous to life after ** hour, and 4815 ppm is fatal in h hour. Elkins (5) reports that industrial poisoning has occurred at concentrations ranging from 50 to 100 ppm or more, but that no ill effects were found among workers exposed to con centrations averaging from 10 to 65 ppm. Barthelemy (6) reports that when carbon di sulfide concentrations are kept below 30 ppm, no trouble was experienced; and Brieger (7) is in substantial accord. Rubin and Arieff (8) found equivocal evidence of toxic effects in persons exposed to an average concentration of from 2 to 26 ppm. As a further point of information, we understand that it was the City's intent to*expand the definitions for fume and explosion hazard gases in Chapter 129 of the new Fire Prevention Code in order to better cover various' liquefied petroleum (LP) gas containers. However, it should be pointed out that the following definition, which includes certain gases -under "any" condition, now exists in the present Cit}' fire code for licensing purposes: "129-2 (d). - Explosion hazard gases, acetylene gasx ammonia gas, ether gas, ethyl chloride gas, ethylene gas, liquefied "hydrocarbon gases, liquefied petroleum gases, hydrogen gas, .illuminating gas, methyl chloride gas and any othe-r gas which is a poisonous, irritant or corrosive gas and is also susceptible to explosion under any condition or is not a poisonous, irritant or. corrosive gas- but is a gas susceptibleto explosion under any condition shall each be defined as an explosion gas.
